Compactor. Tenant shall be entitled to use the Compactor Area for the operation of the trash compactor currently located within the Compactor Area subject to reasonable rules and regulations that Landlord may impose with respect to the operation of such Compactor; provided, however, within sixty (60) days after written request of Landlord, Tenant shall relocate, at Tenant’s expense, the Compactor to an area designated by Landlord (and approved by Tenant, which approval shall not be unreasonably withheld or delayed) within the Complex or Garage. In such event, the Compactor Area shall, from and after the date of such relocation, be the area so designated by Landlord. Tenant, at its expense, shall maintain, repair and replace such compactor and Compactor Area in good repair and condition throughout the Term of this Lease. In consideration of the agreement of Landlord to the specified uses by Tenant of the Special Use Common Areas, Tenant shall pay to Landlord the rent provided for in Section 6.A(4) of the Lease.
Compactor. If the municipality or other governmental agency shall require Tenant to install a garbage compactor or other storage or waste management facility at the premises, Tenant shall, at Tenant's expense, install such equipment and/or storage facility.

Compactor. Subject to Landlord’s right to review and approve all plans and specifications relating to the installation thereof, Landlord hereby grants Tenant the right to install, maintain and replace, at Tenant’s sole cost and expense, from time to time two (2) compactor pads and enclosures with electrical hook-up (“Compactors”) serving the Premises in a location mutually acceptable to Landlord and Tenant. Tenant shall be responsible for the repair of any damage to any portion of the Building, Project or Premises caused by Tenant’s installation, use or removal of the Compactors. Tenant shall cause the construction and installation of the Compactors to be completed in accordance with all applicable Legal Requirements, including without limitation, all applicable zoning ordinances. The Compactors shall remain the exclusive property of Tenant, and Tenant shall have the right to remove the Compactors at any time during the term of the Lease so long as Tenant is not in default. Tenant shall protect, defend, indemnify and hold harmless Landlord from and against any and all claims, damages, liabilities, costs or expenses of every kind and nature (including without limitation reasonable attorneys’ fees) imposed upon or incurred by or asserted against Landlord arising out of Tenant’s installation, maintenance, use or removal of the Compactors.
Compactor. If Tenant determines that any one repair resulting from regular wear and tear and not resulting from a casualty event of the Bay 6 compactor costs more than $200,000 (“Bay 6 Major Repair Amount”) (inclusive of parts and labor, as such amount may be adjusted as described below) (a “Bay 6 Major Repair”), then Tenant shall obtain a written detailed estimate of the parts and labor required to perform such Bay 6 Major Repair and provide such detailed estimate (the “Bay 6 Estimate”) to the District along with any other such documentation as may be reasonably requested by the District. If the District concurs (in its reasonable discretion) that the preventive maintenance and repair records show Proper Maintenance and Repair and the District concurs (in its reasonable discretion) that the repair or replacement of the Bay 6 compactor costs more than $200,000 (as such amount may be adjusted as described below), then Tenant shall perform such Bay 6 Major Repair in accordance with the terms and conditions of this Lease. In the event that during such repair Tenant determines that the cost of such repair will exceed the amount set forth in the Bay 6 Estimate, then Tenant shall provide District written notice of such increased cost and District shall reasonably approve or disapprove such increased cost within five (5) business days following receipt thereof. District’s failure to disapprove such increased cost within such five (5) business day period shall be deemed District’s approval of such increased cost. If District disapproves of the increased cost, District will provide a written explanation for District’s disapproval thereof and any increased costs above the Bay 6 Estimate will be borne by Tenant. Following District’s approval or deemed approval of the increased cost, the Bay 6 Estimate will be deemed adjusted to include such increased cost (the adjusted Bay 6 Estimate, the “Bay 6 Adjusted Estimate”). Upon completion, Tenant shall provide a written invoice to the District which itemizes the parts and labor involved in the Bay 6 Major Repair, and the District shall, within 30 days after receipt of such invoice, reimburse Tenant for the cost of the parts for the Bay 6 Major Repair provided that such cost for the parts in the invoice does not exceed 10% above the amount specified in the Bay 6 Adjusted Estimate; it being understood that with respect to any Bay 6 Major Repair, the District shall pay for the parts (not to exceed 10% above the amount specified in the Ba...
