Common use of Competitive Level Clause in Contracts

Competitive Level. Competitive levels are established in accordance with applicable law and regulations. An employee is assigned to a position in a competitive level in accordance with regulations. Factors considered in the establishing of competitive levels are as follows: (1) A competitive level consists of all the positions in a competitive area that are in the same grade or occupational level and classification series and which are similar enough in qualification requirements, duties, pay schedule, and working conditions, so that the incumbent of one position could successfully perform the critical elements of any other position upon entry into it without any loss of productivity beyond that normally expected in the orientation of any new but fully qualified employee.
