Compliance with Labor Law Section 224-a. The Agency hereby informs the Company that certain Construction work done under contract in connection with financial assistance from the Agency may be subject to the requirements of Section 224-a of the Labor Law of the State, including but not limited to the requirement that such Construction shall be subject to prevailing wage requirements of Section 220 and 220-b of the Labor Law of the State. In addition, such Construction work may be required by Section 224-a of the Labor Law to comply with the objectives and goals of minority and women-owned business enterprises pursuant to Article Fifteen-A of the Executive Law and service-disabled veteran-owned business pursuant to Article Seventeen-B of the Executive Law. The Company shall certify or cause to be certified using the Certificate required by the New York State Department of Labor (currently from PW 39a) within five (5) days of commencement of Construction work, to the Agency and Commissioner of Labor of the State, whether the Project is subject to the provisions of Section 224-a of the Labor Law. A copy of such certification shall be filed with the Agency no later than ten (10) days after filing with the Commissioner of Labor. Notwithstanding the foregoing, by resolution, dated September 17, 2014 (the “Facility Resolution”), the Agency authorized financial assistance with respect to the Project. On October 4, 2017, the Agency and Xxxx Xxx, LLC entered into the Master Benefits Agreement (the “MBA”) regarding such financial assistance. The adoption of the Facility Resolution, and the execution and delivery of the MBA preceded the enactment of Section 224-a of the Labor Law of the State.

Compliance with Labor Law Section 224-a. The Agency hereby informs the Company that, effective January 1, 2022, certain Construction work done under contract in connection with financial assistance from the Agency may be subject to the requirements of Section 224-a of the Labor Law of the State, including but not limited to the requirement that such Construction shall be subject to prevailing wage requirements of Section 220 and 220-b of the Labor Law of the State. In addition, such Construction work may be required by Section 224-a of the Labor Law to comply with the objectives and goals of minority and women-owned business enterprises pursuant to Article Fifteen-A of the Executive Law and service-disabled veteran-owned business pursuant to Article Seventeen-B of the Executive Law.   • COMPLIANCE WITH HEALTH & SAFETY CODE SECTION 25249 7(f) Ecological agrees to comply with the reporting form requirements referenced in California Health & Safety Code § 25249.7(f).
