Conditions for Return. When the DIR Facilities are no longer to be used by Service Provider as contemplated by Section 6.1 or are otherwise no longer required for performance of the Services, Service Provider shall notify DIR as soon as practicable and shall vacate and return such DIR Facilities (including any improvements to such facilities made by or at the request of Service Provider) to DIR in substantially the same condition as when such facilities were first provided to Service Provider, subject to reasonable wear and tear.
Conditions for Return. When the Kraft Facilities are no longer to be used by Supplier as contemplated by Section 6.1.2 or are otherwise no longer required for performance of the Services, Supplier shall notify Kraft as soon as practicable and shall vacate and return such Kraft Facilities (including any improvements to such facilities made by or at the request of Supplier) to Kraft in substantially the same condition as when such facilities were first provided to Supplier, subject to reasonable wear and tear.
Conditions for Return a. Competent proof must be given to the Board that the Administrator applying for return from medical leave of absence is competent and qualified to perform the duties of an administrative position for which application is made.
b. It is the intent and it shall be the policy of the Board to return an Administrator on leave of absence to the same position of like nature, status, and pay, unless seniority as stated in Article IX (Seniority), makes it impossible to do so.
c. Administrator who returns form a childbirth or medical leave within sixty (60) school days shall be assured of his/her previous administrative position.
Conditions for Return. When the ABM Facilities are no longer to be used by Supplier as contemplated by Section 6.1 or are otherwise no longer required for performance of the Services, Supplier shall notify ABM as soon as practicable and shall vacate and return such ABM Facilities (including any improvements to such facilities made by or at the request of Supplier) to ABM in substantially the same condition as when such facilities were first provided to Supplier, subject to reasonable wear and tear.
Conditions for Return. When the TXUED Facilities are no longer to be used by Vendor as contemplated by this Section or are otherwise no longer being used by Vendor to perform the Services, Vendor shall provide ninety (90) days’ prior notice to TXUED and at the end of such ninety (90) days shall vacate and return such TXUED Facilities (including any improvements to such facilities made by or at the request of Vendor) to TXUED in substantially the same condition as when such facilities were first provided to Vendor, subject to reasonable wear and tear.
Conditions for Return. Upon any vacation by Amdocs of SBC Facilities, Amdocs shall return such SBC Facilities (including any improvements to such facilities made by or at the request of Amdocs) to SBC in substantially the same condition as when such facilities were first provided to Amdocs, subject to reasonable wear and tear and any improvements to such facilities made by or at the request of Amdocs; provided, however, that Amdocs shall not be responsible for the acts of SBC or its personnel or subcontractors (other than Amdocs and its Subcontractors and Affiliates) causing damage to such facilities.
Conditions for Return. When the TxDOT Sites are no longer to be used by Service Provider as contemplated by Section 6.1 or are otherwise no longer required for performance of the Services, Service Provider shall notify TxDOT as soon as practicable and shall vacate and return such TxDOT Sites (including any improvements to such facilities made by or at the request of Service Provider) to TxDOT in substantially the same condition as when such facilities were first provided to Service Provider, subject to reasonable wear and tear.
Conditions for Return. An employee returning from a Pregnancy Disability Leave will be restored to the same position as she left or to one with equivalent benefits, pay and other terms and conditions of employment unless, for legitimate business reasons, the position has been abolished. The Appointing Authority may require an employee returning after a Pregnancy Disability Leave to pass such medical examinations as deemed necessary to determine fitness to perform the essential functions of the position.
Conditions for Return. When the Triad Facilities are no longer to be used by Supplier as contemplated by Section 6.1 or are otherwise no longer required for performance of the Services, Supplier shall notify Triad as soon as practicable and shall vacate and return such Triad Facilities (including any improvements to such facilities made by or at the request of Supplier) to Triad in substantially the same condition as when such facilities were first provided to Supplier, subject to reasonable wear and tear.
Conditions for Return. The Hardware must be returned in its original packing in like-new condition for all accessories and documentation included.
