CONDITIONS OF FINANCIAL ASSISTANCE. The Council will make the payment of the Principal Sum on the condition that: The Special Guardians shall obtain the Council’s approval for the Works before the Commencement Date and will need to be satisfied that the Works are carried out and completed satisfactorily in accordance with any necessary planning permission and building regulations approval, certified copies of which should be supplied to the Council; The Special Guardians shall obtain all necessary consents including but not limited to planning permission and building regulations approval and/or deeds of release in respect of any restrictive covenants which may be required in order to enable the proposed building works to be undertaken and for the avoidance of doubt, the Council shall not be liable for any costs, claims, proceedings or liabilities arising from such consents or the failure of the Special Guardians to obtain such consents; The Special Guardians shall ensure that they hold adequate insurance, having regard to the need for any necessary adjustment arising out of the increased value of the Property following completion of the Works; The Special Guardians shall not to make any alterations or additions to the Works (or any applications for planning permission or building regulations consent in relation to the Property) without the prior written consent of the Council such consent not to be unreasonably withheld or delayed; The Special Guardians acknowledge they are responsible for paying all rates, taxes, duties, assessments, impositions and outgoings of whatever nature which may be imposed upon (or payable in respect of) the Property; The Special Guardians permit named Council employees or agents agreed with the Council in advance to enter the Property at all reasonable times and on reasonable notice (except in an emergency) to view the state and condition of the Works or for any other reasonable purposes; and The Special Guardians shall comply with all statutes, orders, regulations, bye-laws and delegated legislation relating to the Special Guardians’ use and occupation of the Property.

  • PROVISION OF FINANCIAL ASSISTANCE As authorized by Section II of this Agreement for the sole and express purpose of financing the Project defined and described in Appendix A of this Agreement, the estimated costs of which are set forth and described in Appendix D of this Agreement, the OPWC hereby agrees to provide financial assistance, subject to the terms and conditions contained in this Agreement, from the Clean Ohio Conservation Fund which constitutes the proceeds of the Infrastructure Bonds, in an amount not to exceed One Million, One Hundred Twenty Four Thousand, Eight Hundred Dollars ($ 1,124,800).   • Financial Assistance Subject to the terms and conditions contained herein, the Director hereby grants to the Recipient financial assistance, as established in this section, for the sole and express purpose of paying or reimbursing the eligible costs certified to the Director under this Agreement for the completion of the Project.
