Consequences of failure to satisfy Conditions Precedent a. If the Concessionaire fails to satisfy any of the Conditions Precedent that it is responsible for under Clause 2.2.4 and fails to take necessary actions to fulfil the Conditions Precedent under Clause 2.2.2 within the prescribed time period, unless waived in accordance with Clause 2.3(c), the Authority shall be entitled to terminate this Agreement by issuing 30 Days' notice to the Concessionaire and forfeit the Performance Bank Guarantee.
