Consultant’s Payments. The Consultant shall promptly pay its employees, and others performing or providing Consultant Services or authorized Additional Consultant Services upon receipt of payments of the Contract Price from the District. If required by applicable law, rule or regulation, the Consultant’s payment to personnel providing or performing Consultant Services or authorized Additional Consultant Services shall be at least the prevailing wage rate established for the type of service provided. If prevailing wage rates apply to any personnel performing or providing Consultant Services or authorized Additional Services, the obligation for compliance rests solely with the Consultant, without adjustment of the Contract Price.

If prevailing wage rates apply to any personnel performing or providing T&I Services or authorized Additional Services, the obligation for compliance rests solely with the Consultant without adjustment of the Contract Price for T&I Services for the Project.
