Consumer’s rights. New Relic will, upon Customer’s instructions (and at Customer’s expense): (a) use reasonable efforts to assist Customer in deleting Personal Information in accordance with a Consumer’s request (and shall instruct any service providers it has appointed to do the same) except where and to the extent permitted to retain the Personal Information pursuant to an exemption under the CCPA and/or the CPRA; and (b) use reasonable efforts to assist Customer in responding to verified Consumer requests received by Customer to provide information as it relates to the Collection of Personal Information for the Business Purpose.

Consumer’s rights. Contractor shall provide resident, at the time of entry, a written copy of the consumer’s rights. The document shall be written so as to be in conformance with the mandates of Welfare and Institutions Code, Division 5, Section 5325, and California Administrative Code, Title 9, Article 6. As part of Patient Rights, Board and Care operators are prohibited from restricting the consumer from leaving the facility premises. Restricting the rights of consumers is a violation of the patient’s rights under these provisions.
Consumer’s rights. Talend is liable to the consumer for any lack of conformity which exists at the time the goods are delivered. In the case of a lack of conformity, the consumer shall be entitled to have the goods brought into conformity free of charge by repair or replacement or to have an appropriate reduction made in the price or the contract rescinded with regard to those goods. The consumer may require Talend to repair the goods or he/she may require Talend to replace them, in either case free of charge, unless this is impossible or disproportionate. A remedy shall be deemed to be disproportionate if it imposes costs on Talend which, in comparison with the alternative remedy, are unreasonable, taking into account: (i) the value the goods would have if there were no lack of conformity, (ii) the significance of the lack of conformity, and (iii) whether the alternative remedy could be completed without significant inconvenience to the consumer. Any repair or replacement shall be completed within a reasonable time and without any significant inconvenience to the consumer, taking account of the nature of the goods and the purpose for which the consumer required the goods. The above mentioned terms "free of charge" refer to the necessary costs incurred to bring the goods into conformity, particularly the cost of postage, labor and materials. The consumer may require an appropriate reduction of the price or have the contract rescinded: (i) if the consumer is entitled to neither repair nor replacement, or (ii) if the seller has not completed the remedy within a reasonable time, or (iii) if the seller has not completed the remedy without significant inconvenience to the consumer. The consumer is not entitled to have the contract rescinded if the lack of conformity is minor.
Consumer’s rights. 9.1. The provisions of this Section 9 apply only to Users that fall under the category of “consumer” pursuant to the Italian Legislative Decree 6 September 2005, No. 206 (the “Italian Consumers Code”).
Consumer’s rights. If Customer enters into this Agreement: (a) this Agreement will not be in effect unless Planet provides a text-based copy of the Agreement to Customer within 40 days after signing this Agreement; (b) except for agreements entered into by mailed response or over the internet, this Agreement will not be in effect unless Customer verifies it in accordance with Section 15(1) of the Energy Consumer Protection Act, 2010 (Ontario) (“ECPA”) after the 10th day and before the 46th day following the day on which Customer receives a text-based copy of this Agreement; (c) Customer has the right to cancel this Agreement without cost or penalty within 10 days after Customer acknowledges receipt or is deemed to acknowledge receipt of a text-based copy of this Agreement (if Customer enters the Agreement via the internet, Customer is deemed to have acknowledged receipt when a copy of this Agreement is emailed to Customer); (d) if Customer cancels this Agreement within the 10-day period pursuant to (c) above, Customer is entitled to a full refund of all amounts paid under the Agreement; (e) in the case of an Agreement for Electricity, Customer may cancel this Agreement, as it relates to Electricity, without cost or penalty up to 30 days after receiving the first xxxx under this Agreement; and (f) nothing in this Agreement negates or varies Customer’s right to cancel this Agreement in accordance with the ECPA and regulations thereunder. Section 11 does not apply if Customer is not a Low- Volume Consumer.
Consumer’s rights. If the Software User is entering into this Agreement as a consumer, i.e. is a natural person who trades primarily for use outside of the course of business operation, mandatory law does not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential damages. The limitations above may therefore not be applicable. This Agreement does not affect any rights that a consumer has under applicable mandatory consumer legislation. In the event of a conflict between this Agreement and applicable mandatory consumer legislation, the latter shall prevail. Consumer’s rights. The Order shall not limit or impair a consumer’s rights under the MLA.
Consumer’s rights. With regards to the consumers’ right to delete, the Service Provider shall cooperate with the Client in responding to a verifiable consumer request, and at the direction of the Client, shall delete or enable the Client to delete and shall notify any of its own service providers or contractors to delete personal information about the consumer collected, used, processed or retained by the Service Provider, except to where and to the extent permitted to retain the personal information pursuant to an exemption under the CCPA and/or CPRA. The Service Provider shall notify any service providers, contractors or third parties who may have accessed personal information from or through the Service Provider, unless the information was accessed at the direction of the Client, to delete the consumer’s personal information unless this proves impossible or involves disproportionate effort. The Service Provider shall not be required to comply with a deletion request submitted by the consumer directly to the Service Provider. Insofar as a consumer contacts the Service Provider directly in this respect, the Service Provider will immediately forward this request to the Client without delay. With regards to the consumers’ right to know what personal information is being collected, right to access personal information and right to know what personal information is sold or shared and to whom, the Service Provider shall provide assistance to the Client with respect to the Client’s response to a verifiable consumer request, including, but not limited to, by providing to the Client the consumer’s personal information in the Service Provider’s possession and by correcting inaccurate information or by enabling the Client to do the same as it relates to the collection of personal information for the business purpose.
