MEMBER’S RIGHTS. Each Member shall have the following right:
A) To attend all meetings and have the same right to speak as Directors except during executive session
B) To cast one vote at all Membership Meetings and polls.
C) To make and second resolutions, motions, or approvals at meetings and
D) To reside at or use the facilities of the corporation to which the Member has been assigned.
MEMBER’S RIGHTS. In addition to all other rights and remedies that a Member may have at law and in equity, including, but not limited to, under the Act, a Member may bring any action against the Manager, another Member and/or the Company to enforce the terms and provisions of this Agreement, to obtain a judgment for damages for a breach of this Agreement, and/or to cause the Manager and/or a Member to perform its obligations under this Agreement.
MEMBER’S RIGHTS. The Chief or Deputy Chief shall be responsible to ensure that all allegations of misconduct and other violations shall be investigated. Such investigation shall be completed within a reasonable time based upon the circumstances or the alleged misconduct and the investigation. If the investigation is as a result of a complaint from the public, misconduct or other violations that come to the attention of a superior officer, the following procedure shall be followed: The Chief or Deputy Chief (or designated officer) shall investigate all such allegations. Such investigator shall inform any member under investigation and his/her commanding officer of the nature of the investigation before it commences. If diligent efforts to contact the member fail, the investigator shall advise the designated representatives of the Association. If the investigation is the result of an outside complaint, the Investigator shall mail written notice or e-mail notice to the member and the MSTA within fourteen (14) calendar days after providing verbal notice. The member’s notice shall be sent to the member’s work location. The MSTA’s notice shall be sent to their business address. Sufficient information to apprise the member of the specific allegations will be provided. The investigating officer shall be allowed to interview the complainant prior to notifying the member. Where no probable cause is found, the investigation will terminate and the record shall not become part of the member's personnel file. When an investigator believes that there is reasonable cause to interview a member under investigation concerning an alleged violation of the Department's operating procedure or misconduct, the member shall be afforded forty-eight (48) hours, unless an emergency exists or such right is waived, to contact and consult privately with an attorney or other counsel of his/her own choosing before being interviewed. The interview of any Department member shall be at a reasonable hour, preferably when the member is on duty, and during the daylight hours, unless the course of the investigation dictates otherwise, and such interview will be conducted without unreasonable delay. The interview shall take place at a location designated by the investigating officer and shall be at a State Police headquarters when feasible. MEMBER’S RIGHTS. No provision in this Agreement will be construed to deny or to restrict the rights granted to unit members under state and federal laws and regulations. The rights granted to unit members by this Agreement will be deemed to be in addition to those specifically provided in District policy.
MEMBER’S RIGHTS. YOU ARE ENTITLED TO A COPY OF THIS AGREEMENT AT THE TIME YOU SIGN IT, YOU MAY CANCEL THIS AGREEMENT AT ANY TIME BEFORE MIDNIGHT OF THE THIRD DAY AFTER RECEIVING A COPY OF THIS AGREEMENT. IF YOU CANCEL THIS AGREEMENT WITHIN THE THREE–DAY PERIOD, YOU ARE ENTITLED TO A FULL REFUND OF YOUR MONEY LESS AN AMOUNT EQUAL TO THE VALUE OF ANY SERVICES RECEIVED AT THE STANDARD RATES THAT OTHERWISE WOULD HAVE BEEN CHARGED BY THE COMPANY IF YOU HAD NOT PURCHASED A MEMBERSHIP. IN THE EVENT THAT THERE IS A BALANCE DUE TO THE COMPANY FOR SERVICES PROVIDED AND YOU TERMINATE YOUR MEMBERSHIP IN ACCORDANCE WITH THIS SECTION 7, YOU AUTHORIZE THE COMPANY TO CHARGE YOUR CREDIT CARD FOR ANY SUCH AMOUNTS DUE. IF THE THIRD DAY FALLS ON A SUNDAY OR A HOLIDAY, NOTICE IS TIMELY GIVEN IF MAILED OR DELIVERED AS SPECIFIED IN THIS NOTICE ON THE NEXT DAY FOLLOWING A SUNDAY OR HOLIDAY, AS APPLICABLE. REFUNDS MUST BE MADE WITHIN THIRTY DAYS OF RECEIPT OF THE CANCELLATION NOTICE BY THE COMPANY. ALL CANCELLATION REQUESTS MUST BE SUBMITTED BY COMPLETING THE ONLINE PASSPORT TERMINATION FORM (AVAILABLE AT XXX.XXXXXXXXXX.XXX/XXXXXXXXXX-XXXXXXXXXXX/).
MEMBER’S RIGHTS. A. Under this article, a member holding a permanent assignment in more than one department has the same rights and privileges of regular members of the involved departments.
B. The member who receives an administrative assignment to maintain load shall have the same voting privileges in each department as other members in all departments to which the member is assigned. The member shall have only one vote on any Division‐ or College‐wide issue.
C. If seniority is used for any purpose within a department (such as the assignment of overloads), then seniority within the department shall be based on the date a member enters the department. Note, seniority within a department does not supersede the seniority rights established by law for purposes of a reduction in force (See Article 26).

If the investigation is as a result of a complaint from the public, misconduct or other violations that come to the attention of a superior officer, the following procedure shall be followed: Upon receipt/knowledge of an allegation of misconduct or other violations(s) by a member, the Lieutenant or Sergeant of the Office of Professional Standards (OPS) will seek to determine if there are recordings or reports related to the circumstances surrounding the allegation. The Lieutenant or Sergeant will consider several issues, including but not limited to, the following before moving forward:
a. nature of the allegation(s); and
b. history of the member(s) involved. UNFOUNDED/EXONERATION: If review of the recording(s) prove the member’s actions are within policies, procedures, rules and regulations, and provide a clear and complete rebuttal of the allegations, the case will be closed as Unfounded or with the member being Exonerated, and the designated representative of the Association will be notified.
MEMBER’S RIGHTS. Unless it can be reasonably determined that the effective operation of classroom activities is interfered with:
MEMBER’S RIGHTS. When requested by the insured or the insured’s agent, Montana law requires Blue Cross and Blue Shield of Montana to provide a summary of a Member’s coverage for a specific health care service or course of treatment when an actual charge or estimate of charges by a health care provider, surgical center, clinic or Hospital exceeds $500. It is the policy of Blue Cross and Blue Shield of Montana to protect the privacy of Members through appropriate use and handling of private information. Further, appropriate handling and security of private information may be mandated by state and/or federal law. The Beneficiary Member may receive a copy of Blue Cross and Blue Shield of Montana’s "Notice of Privacy Practices," or other information about privacy practices, by calling the telephone number or writing to the address shown on the inside cover of this Contract.
MEMBER’S RIGHTS. 32.1 Members shall have access to all of their personnel records at reasonable times (0830 - 1600 hours), Monday to Friday, and shall, upon request, be provided with copies of material contained in such records, which shall be corrected if inaccurate, or purged if inappropriate; and where a dispute arises and satisfactory settlement cannot be reached, recourse shall be sought through the grievance procedure.
32.2 Where a member has been documented or disciplined, all records of such discipline shall be purged from the member's personnel file after a discipline free period of two years.
32.3 Where a member becomes mentally or physically disabled the Board shall accommodate the member's needs in accordance with the Ontario Human Rights Code and Section 47 of the Police Services Act.
32.4 Voluntary overtime shall be distributed as equitably as possible amongst members in the Section where the overtime occurs.
32.5 A member shall be entitled to prior notice in advance of any disciplinary meeting. The member shall have the right to consult with or be accompanied by an Association Representative of their choice if the member so requests.
