Content and Conduct. Subscriber agrees to comply with the Zendesk User Content and Conduct Policy (as defined below) which is hereby incorporated into this Agreement. Further, in Subscriber’s use of the Services Subscriber agrees not to (a) modify, adapt, or hack the Services or otherwise attempt to gain unauthorized access to the Services or related systems or networks; (b) attempt to bypass or break any security or rate limiting mechanism on any of the Services or use the Services in any manner that interferes with or disrupts the integrity, security or performance of the Services and its components; (c) attempt to decipher, decompile, reverse engineer or otherwise discover the source code of any Software making up the Services; or (d) to the extent Subscriber is subject to the US Health Insurance Portability and Accountability Act of 1996, and its implementing regulations (HIPAA), use the Services to store or transmit any “protected health information” as defined by HIPAA, unless expressly agreed to otherwise in writing by Zendesk.

Content and Conduct. Client understands and agrees that all Content, whether publicly posted or privately transmitted, used in connection with the Survey are the sole responsibility of the person or entity from which such Content originated. Client, and not Survox, is entirely responsible for all Content that it uploads, posts, transmits or otherwise makes available via Survox Hosted Services. Client agrees that it will not: (i) upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; (ii) upload, post or otherwise transmit any Content that Client does not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); (iii) upload, post or otherwise transmit any Content that infringes any rights of privacy or publicity. Client is responsible for compliance with all applicable privacy laws, including but not limited to, the Children’s Online Privacy Protection Act (COPPA), the Xxxxx-Xxxxx-Xxxxxx Act of 1999 (GLBA for financial privacy), the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Telephone Consumer Protection Act (TCPA) affecting phone calls made with automated dialers, and applicable European Union Directives; (iv) falsely impersonate any person or entity, or falsely state or otherwise misrepresent its affiliation with a person or entity; Survox shall have the right to monitor the Survey to ensure compliance by Client with any and all provisions of this Section 8.7.

KLIENTS tālāk piekrīt un atzīst, ka Autorizētā Lietotāja Pieteikšanos nevar kopīgot vai izmantot vairāk par vienu indivīdu, bet Autorizētā Lietotāja Pieteikšanās var tikt iedalīts jaunām personām, kas aizstāj iepriekšējās personas, kurām vairāk nav nepieciešama turpmāka Pakalpojumu izmantošana. KLIENTS un KLIENTA Autorizētais Lietotājs ir atbildīgi par konfidencialitātes informāciju, kas attiecas uz Autorizētā Lietotāja Pieteikšanos KLIENTA Kontam. Neesošas STRONGPOINT rakstiskas licences gadījumā, kurā xxxxx norādīts pretējais, KLIENTS piekrīt un atzīst, ka KLIENTS neizmanto Pakalpojumus, ieskaitot, bet aprobežojoties ar API, lai apietu prasību par individuālu Autorizētā Lietotāja Pieteikšanos priekš katra indivīda, kurš (a) izmanto Pakalpojumus, lai mijiedarbotos ar Gala Lietotājiem; (b) Apstrādā datus, kas attiecas uz mijiedarbošanos ar Gala Lietotājiem; vai (c) Apstrādā datus, kas attiecas uz mijiedarbošanos, kas izceļas ar Pakalpojumiem, ko neveic STRONGPOINT un kas nodrošina Pakalpojumiem līdzīgu funkcionalitāti, un kas saskaņā ar šo Līgumu prasa individuālu Autorizēta Lietotāja Pieteikšanos, ja Pakalpojumi tiek izmantoti šādai mijiedarbībai. Gadījumā, ja STRONGPOINT uzzina, ka KLIENTS izmanto STRONGPOINT Pakalpojumus neatbilstoši Līguma noteikumiem vai Pakalpojumu Plāna funkcijām un ierobežojumiem STRONGPOINT Vietnē, STRONGPOINT patur tiesības iegūt atlīdzību no KLIENTA, un KLIENTS ar šo piekrīt samaksāt piemērojamo maksu un citus maksājumus par minēto neatļauto izmantošanu un papildus citus tiesiskās aizsardzības līdzekļus, ko STRONGPOINT izmantojis kā nepieciešamību attiecībā uz Līguma pārkāpšanu.
