Common use of - Cost of Living Allowance Fold-In Clause in Contracts

- Cost of Living Allowance Fold-In. (a) effective September 2003 the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.3 of the new Collective Agreements during each month up to and including August 2004 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate; (b) effective September 2004 the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 of the new Collective Agreements during each month up to and including August 2005 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (c) effective September 2005 the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 of the new Collective Agreements during each month up to and including August 2006 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (d) effective September 2006 the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 of the new Collective Agreements during each month up to and including August 2007 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (e) effective September 2007 the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 of the new Collective Agreements during each month up to and including August 2008 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate.

(a) effective September 2003 October 1st, 2003, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.3 37.3 of the new Collective Agreements during each month up to and including August 2004 September 2003 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate;. (b) effective September 2004 October 1st, 2004, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 37.4 of the new Collective Agreements during each month up to and including August 2005 September 2004 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (c) effective September 2005 October 1st, 2005, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 37.5 of the new Collective Agreements during each month up to and including August 2006 September 2005 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (d) effective September 2006 October 1st, 2006, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 37.6 of the new Collective Agreements during each month up to and including August 2007 September 2006 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (e) effective September 2007 October 1st, 2007, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 37.7 of the new Collective Agreements during each month up to and including August 2008 September 2007 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate.

Such average rate will then be added to the regular hourly rate;. (b) effective September 2004 October 1st, 2004, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 35.4 of the new Collective Agreements during each month up to and including August 2005 September 2004 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (c) effective September 2005 October 1st, 2005, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 35.5 of the new Collective Agreements during each month up to and including August 2006 September 2005 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (d) effective September 2006 October 1st, 2006, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 35.6 of the new Collective Agreements during each month up to and including August 2007 September 2006 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (e) effective September 2007 October 1st, 2006, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 35.7 of the new Collective Agreements during each month up to and including August 2008 September 2006 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate.

(a) effective September 2003 Effective October lst, 1996, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.3 37.3 of the new Collective Agreements during each month up to and including August 2004 September 1996 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate;. An identical calculation of average mileage Cost of Living allowance rate and adjustment to the regular mileage rate shall be made in the same manner and at the same time as set out above. (b) effective September 2004 Effective October lst, 1997, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 37.4 of the new Collective Agreements during each month up to and including August 2005 September 1997 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such Section 38.1 average rate will then be added to the regular hourly rate. An identical calculation of average mileage Cost of Living Allowance rate and adjustment to the regular mileage rate shall be made in the same manner and at the same time as set out above. c) Effective October lst, 1998, the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 37.6 of the new Collective Agreements during each month up to and including September 1998 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (c) effective September 2005 the . An identical calculation of average of the hourly mileage Cost of Living Allowance rates which were paid pursuant to Section 23.4 of the new Collective Agreements during each month up to rate and including August 2006 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added adjustment to the regular hourly ratemileage rate shall be made in the same manner and at the same time as set out above. (d) effective September 2006 the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 of the new Collective Agreements during each month up to and including August 2007 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate. (e) effective September 2007 the average of the hourly Cost of Living Allowance rates which were paid pursuant to Section 23.4 of the new Collective Agreements during each month up to and including August 2008 will be determined by calculating the sum of the rates during each such month and dividing this amount by twelve (12). Such average rate will then be added to the regular hourly rate.
