COUNTY COUNCIL’S COVENANTS. 4.1. The County Council covenant with the Owners to observe and perform the covenants, restrictions and obligations contained in Schedule 4.
COUNTY COUNCIL’S COVENANTS. The County Council covenants with the Owners to use all sums received from the Owner under the terms of this Deed for the purpose(s) specified in this Deed for which they are paid .
COUNTY COUNCIL’S COVENANTS. 8.1 The County Council covenants that upon receipt of the Education Contribution, Library Contribution, Fire and Rescue Service Contribution and Total Access Demand Contribution from the District Council it will hold it in a separately identified interest bearing section of the County Council’s combined accounts and apply the same towards the cost of education library fire and rescue and transport infrastructure in the vicinity of the Land
8.2 The County Council covenants that upon written request within ten years of the date of receipt of the Education Contribution Library Contribution Fire and Rescue Service Contribution and Total Access Demand Contribution it will issue to the party that paid the said contribution an account certified by the Executive Director of Finance and Performance for the time being of the County Council detailing the scheme on which the Education Contribution Library Contribution Fire and Rescue Service Contribution and Transport Contribution has been expended by the County Council
8.3 If or to the extent the Education Contribution Library Contribution Fire and Rescue Service Contribution and Total Access Demand Contribution shall not have been spent by the County Council at the end of the period referred to in paragraph 8.2 above the County Council shall on such date refund to the party that paid the Education Contribution Library Contribution Fire and Rescue Service Contribution and Total Access Demand Contribution any unexpended sum together with compound interest on such unexpended sum from the date of receipt of the said contributions by the County Council to the date of repayment at the base rate of the Bank of England applicable at the date of repayment calculated on a day to day basis.
8.4 If at the end of the period referred to in paragraph 8.2 above the County Council shall have entered into a contract or other legally binding obligation to expend the Education Contribution Library Contribution Fire and Rescue Service Contribution and/or Total Access Demand Contribution or part thereof for the purposes specified in paragraph 8.1 above then the County Council shall not be required to refund any part of the Education Contribution Library Contribution Fire and Rescue Service Contribution and/or Total Access Demand Contribution required for that purpose but shall as soon as possible following the completion of the said contract or other legally binding commitment account to the party that paid the Education Contribution Lib...
COUNTY COUNCIL’S COVENANTS. 6.1 The County Council covenants with the Owner as follows:
6.1.1 To comply with and observe its obligations as set out in Schedule 1
6.1.2 Not to cause or permit the expenditure of any Contributions other than for the purposes for which the Contribution has been paid as expressed in the relevant definition.
6.1.3 To pay each Contribution into an interest-bearing account and if the Contributions (or any part thereof) shall not have been expended or contractually committed to be expended within the time period specified in the relevant provision of the Schedules hereto then the County Council covenants that the unspent part of the relevant Contribution shall be returned to the payee together with all accrued interest within 20 Working Days of a written request to do so.

COUNTY COUNCIL’S COVENANTS. The County Council agrees with the Owner that in the event that the Library Contribution has not been committed towards the purpose set out in this schedule within ten (10) years of the receipt of the payment in full or (if later) the Occupation of the last Dwelling on the Site then the County Council will on the receipt of a written request by the person who paid the sum repay the balance of any sums not committed to the person who paid those sums
COUNTY COUNCIL’S COVENANTS. The County Council covenants to take the transfer of the Primary School Land on or before Occupation of 180 Dwellings, unless another trigger has been agreed by County Council pursuant to paragraph 4.5 of this Schedule.
COUNTY COUNCIL’S COVENANTS. The County Council covenants with the Owner that if so requested by the Owner at anytime after the fifth anniversary of the receipt by the County Council of the Toucan Crossing Contribution paid pursuant to paragraph 1 of the Schedule, the County Council will forthwith repay to the Owner (subject to the provisions of clause 3.8) whatever part of that sum for which written evidence has not been provided by the County Council to the Owner within three months of the Owner’s request as having been expended by the date of the request for the purposes described in that paragraph 1.

The County Council hereby covenants as follows with the Owner: to deposit all monies received pursuant to this Deed into an identifiable account PROVIDED THAT the County Council shall be entitled to use all interest accrued on those monies from the date the actual payment is made until the date the actual monies are spent towards the purpose for which those monies were paid; to expend all monies received pursuant to this Deed and interest earned solely for the purpose for which the monies have been paid as set out in this Deed and as soon as reasonably possible following receipt of each of the said sums not to use any monies received pursuant to this Deed other than for the relevant purpose set out in this Deed; upon the written request of the Owner to provide the Owner with a written statement detailing the extent and nature of the expenditure of any sum received by the County Council pursuant to this Deed; as soon as reasonably practicable following receipt of a written request from the Owner requesting confirmation that one or more of the Planning Obligations has been complied with to issue to the Owner a letter confirming the said discharge PROVIDED THAT such a request may be made at any time after the end of the period during which any such Planning Obligation is imposed and more than one such request may be made in relation to any such Planning Obligation; if at the end of 10 years from the date which the relevant contribution has been paid any sum of money received by the County Council pursuant to this Deed has not been expended for the purpose for which it was paid or deemed to have been paid to reimburse the unexpended sum together with any interest accrued (if any interest has accrued and for the avoidance of doubt, there is no obligation to accrue interest at any particular rate) to the Owner PROVIDED THAT such reimbursement shall be made as soon as reasonably practicable upon written request from the Owner from the end of the said 10 year period and if before the expiry of the relevant period there is any contract or contracts in existence (including for the avoidance of doubt any provisions of works on services by the County Council's direct service organisation) which in the reasonable discretion of the County Council is attributable to the purpose for which the relevant contribution was made and such contract or contracts shall be completed after the expiry of the relevant period then any sum to be repaid to the Owner shall be repaid in acc...
