COUNTY’S REMEDIES CUMULATIVE. County’s rights to suspend or terminate the agreement under Section 15.04, to obtain specific performance under Section 15.05 and to perform under Section 15.06 are not exclusive, and County’s exercise of one such right shall not constitute an election of remedies. Instead, they shall be in addition to any and all other legal and equitable rights and remedies that County may have, Including a legal action for damages under Section 15.07.
COUNTY’S REMEDIES CUMULATIVE. All of County’s remedies under this Lease shall be in addition to all other remedies County may have at law or in equity. Waiver by County of any breach of any obligation by Lessee shall be effective only if it is in writing, and shall not be deemed a waiver of any other breach, or any subsequent breach of the same obligation. County’s acceptance of payment by Lessee shall not constitute a waiver of any breach by Xxxxxx except for any breach with respect to the payment so accepted. County may advance such monies and take such other actions for Xxxxxx’s account as reasonably may be required to cure or mitigate any default by Lessee. Lessee shall immediately reimburse County for any such advance, and such sums shall bear interest at the default interest rate until paid.

The County's right to terminate this Agreement under Section 9.1, and 9.3 and to take possession of Contractor's properties under Section 9.5 are not exclusive, and the County's termination of the Agreement shall not constitute an election of remedies. Instead, all remedies provided for in this Agreement shall be in addition to any and all other legal and equitable rights and remedies which the County may have under law or as otherwise provided in this Agreement. By virtue of the nature of this Agreement, the urgency of timely, continuous, and high quality service, and the lead time required to effect alternative service, the remedy of damages for a breach hereof by the Contractor is inadequate and the County shall be entitled to injunctive relief if it so desires.
