Covenant Running with Land. The Property Owner agrees whenever the Property is held, sold, conveyed or otherwise transferred during the Term of this Agreement, the Property shall be subject to this Agreement which shall apply to, bind and be obligatory to all then current owner(s) of Property. This Agreement shall constitute a real covenant running with the land for the Term of this Agreement, and shall be binding on the Property Owner, its administrators, executors, heirs, assigns, and any other successors in interest during the Term of this Agreement, including, without limitation, any successors in title to the Property or any part thereof, whether or not they have actual notice of this Agreement and whether or not the deed of transfer specifically states that the transfer is under and subject to this Agreement. It is further understood and agreed that subject to the terms of this Agreement, the City shall have peaceful and quiet enjoyment of its rights under this Agreement free and clear of rights or consent of third parties [optional:, other than those that exist as of the Effective Date of this Agreement, as identified in Exhibit C3].

Covenant Running with Land. The covenants and agreements granted herein are and shall be deemed to be covenants running with the land and shall be binding upon the parties hereto and upon their successors and assigns until the expiration of the Easement Term.

Covenant Running with Land. The Declarants do hereby covenant and agree to restrict, and do by this instrument intend to restrict, the future use of the restricted Property as set forth below, by the establishment of this covenant running with the land, which shall also be an equitable servitude for the purpose of regulating the future uses of the Restricted Property.

Covenant Running with Land. The Option and all of the covenants, conditions, and terms of this Agreement, including the right of Waterton to acquire Grantor’s right to receive or obtain its undivided interest in the Mineral Ridge Properties, shall (a) be of benefit to the parties, (b) run as a covenant with the Mineral Ridge Properties and the ground covered thereby (including any interest derived from the federal government in the event of the amendment or repeal of the General Mining Law of 1872), and (c) bind and inure to the benefit of the parties and their respective successors and permitted assigns (including any third party who acquires any interest in the Property). The Option, this Agreement and the performance of the provisions hereof attaches to the Mineral Ridge Properties.
Covenant Running with Land. The Royalty and all of the covenants, conditions, and terms of this Agreement shall (a) be of benefit to the parties, (b) run as a covenant with the Property and the ground covered thereby (including any interest derived from the federal government in the event of the amendment or repeal of the General Mining Law of 1872), and (c) bind and inure to the benefit of the parties and their respective successors and assigns (including any third party who acquires any interest in the Property). The Royalty, this Agreement and the performance of the provisions hereof attaches to the Property and shall remain an obligation of all persons who subsequently acquire, receive or obtain all or any interest in the Property. The Royalty shall attach to any amendments, relocations, restakings or conversions of any of the unpatented mining claims comprising a portion of the Property, or any real property interests which replace those claims which are created by amendments to federal or state mining laws or otherwise.
Covenant Running with Land. This AGREEMENT shall be deemed a covenant running with the REAL PROPERTY. All of the covenants, obligations, and provisions of this AGREEMENT shall be binding upon and inure to the benefit of successors, legal representatives and assigns of the Parties. Every person who now or hereafter owns or acquires any right, title, or interest in and to any portion of the REAL PROPERTY shall be conclusively deemed to have notice of this AGREEMENT, whether or not reference to this AGREEMENT is contained in the instrument by which such person acquires an interest in the REAL PROPERTY. Therefore, each and every contract, deed or other instrument hereinafter executed, covering or conveying the REAL PROPERTY shall conclusively be deemed to have been executed, delivered and accepted subject to this AGREEMENT.
