COVENANTS BY THE OWNER. The Owner covenants with the Resident to perform and observe the covenants imposed on the Owner under this Contract, including those specified in Schedule Five.
COVENANTS BY THE OWNER. 4.1 The Owner covenants with the District Council/Borough Council and the County Council to observe and perform the obligations on its part contained in the Schedules.
4.2 The Owner covenants with the District Council/Borough Council and the County Council with the intent that these are planning obligations for the purposes of Section 106 of the Act.

With the intent that the Land shall be subject to the obligations and restrictions contained in this agreement for the purpose of restricting or regulating the Development or the use of the Land so that the provisions of this agreement shall be enforceable against the Owner and her successors in title the Owner hereby covenants with UDC that [insert details of obligations] The liability of the Owner under this agreement shall cease once she has parted with her interest in the Land but without prejudice to any antecedent liabilities The Developer will give UDC not less than 28 days notice of its intention to implement the permission specifying the intended Implementation Date Forthwith upon Implementation the Developer will give UDC notice of Implementation No waiver (whether express or implied) by UDC of any breach or default in performing or observing any of the obligations or covenants contained in this agreement shall constitute a continuing waiver and no such waiver shall prevent UDC from enforcing any of the said obligations or covenants or from acting upon any subsequent breach or default This agreement constitutes a Local Land Charge and shall be registered as such The Owner will pay the reasonable costs of UDC in connection with the negotiation and preparation of this agreement.
COVENANTS BY THE OWNER. The Owner covenants as follows:
COVENANTS BY THE OWNER. (a) The Owner acknowledges that the Owner has covenanted with CEO (Housing) for the Term:
(i) Pursuant to clause 10] of the Development and Funding Agreement to provide the Property Management Services in respect of the Land;
(ii) Pursuant to clause 11.1 of the Development and Funding Agreement not to mortgage, charge or otherwise encumber its estate or interest in the Land without the prior written consent of CEO (Housing);
(iii) Pursuant to clause 11.2 of the Development and Funding Agreement not to sell, assign, transfer or otherwise dispose of its estate or interest in the Land without the prior written consent of CEO (Housing); and
(iv) Pursuant to clause 11.3 of the Development and Funding Agreement, not to let or lease its estate or interest in the Land other than to Eligible Tenants (as that expression is defined in the Development and Funding Agreement) without the prior written consent of CEO (Housing).
(b) The Owner shall not for any reason without the prior written consent of CEO (Housing) deal with the Land or any part thereof in the manner outlined in subclause 2(a)(ii), 2(a)(iii) or 2(a)(iv).
COVENANTS BY THE OWNER. 4.1 The Owner hereby covenants with the County Council that it shall carry out and comply with the restrictions provisions and obligations contained in Schedule 3.
4.2 The Owner hereby covenants with the Council that it shall carry out and comply with the restrictions provisions and obligations contained in Schedule 4.
COVENANTS BY THE OWNER. The owner covenants and agrees as follows:
a) The Owner is the registered owner of the subject lands described herein, and has provided the Municipality with a Registered Deed containing the legal description of the subject lands.
b) This Agreement may be registered against title to these subject lands, at the expense of the Owner, and shall take priority over any subsequent registrations against the title to the subject lands.
c) The Owner shall, prior to the execution of this Agreement, pay all Municipal taxes.
d) The Owner shall obtain all necessary approvals from the Municipality and from all Ministries and Agencies, including, but not limited to the County of Grey and the Grey Sauble Conservation Authority.
e) That this agreement shall be binding on the landowner or landowners from time to time, their heirs, executors, administrators, successors and assigns.
f) All works, once constructed or provided in accordance with the requirements of this Agreement shall be properly maintained and repaired as required to the satisfaction of the Municipality at the Owner’s sole expense.
g) The location of the tower, guy wires, and access road shall be in accordance with the Site Plan prepared by X.X.Xxxxx Consultants, dated March 22nd, 2006.
h) That access to the tower will be provided through an existing laneway on the adjacent lands owned by Xxxx and Xxxxxx Xxxxxx. Direct access shall not provided via the Osprey / Artemesia Townline.
i) The use of the subject lands must conform with the requirements of the implementing Zoning By-law, and all other By-law’s and regulations of the Municipality, the County of Grey, and all other agencies.
j) The Owner acknowledges that the erection and continued use of the meteorological tower is subject to the provisions of By-law No. 2006-94, and all other provisions of the Municipality of Grey Highlands Comprehensive Zoning By-law No. 2004-50 or its successor, and all other By-laws and regulations of the Municipality, the County of Grey and other agencies.
k) The Owner agrees to post securities with the Municipality in the amount of $2,500.00 to be held until the meteorological tower is to be removed from the property. In the event the temporary use by-law lapses, and no extension has been approved, the Owner shall immediately remove the tower from the property. In the event the tower is not removed, the Municipality may draw upon the securities and dismantle the tower.
COVENANTS BY THE OWNER. To provide a vehicle with a valid Comprehensive insurance cover and all other necessary documents as may be required by the law to be available and displayed. To provide a well serviced and suitable vehicle. To make sure the vehicle has a full equipped first aid box. Provides a vehicle with a full-equipped toolbox and other tools like car xxxx, a working fire extinguisher, spare tires and any other tool necessary for a safari. Provide reliable contacts in case of emergency breakdown or accident. Provides another car in the event of the natural accident
COVENANTS BY THE OWNER. The Owner covenants that it shall serve the Implementation Notice on the Council’s Strategic Director of Development (or such other officer for the time being performing those functions) before carrying out any Implementation Works The Owner covenants with the Council not to carry out any Implementation Works before the service of the Implementation Notice The Owner covenants to pay the _XXXX Sum to the Council on the date of service of the Implementation Notice, which date shall subject to clause [10.7] constitute the Due Date for the _XXXX Sum
