CPI Review. The Rent on and from each Review Date specified in Item 5B is to be reviewed to movements in the CPI in accordance with the following formula: R2 = R1 x Current CPI Where: R2 is the Rent after the Review Date; and R1 is the Rent immediately before the Review Date (disregarding any abatements incentives or reductions).
CPI Review. Where the Rent is to be reviewed to a CPI Review, the Rent on and from that Review Date is calculated as follows: R R CurrentCPI
CPI Review. (a) A rent review based on CPI will increase the amount of Rent payable during the immediately preceding period by the percentage of any increase in CPI having regard to the quarterly Perth CPI published for the March quarter of each year.
(b) Should the CPI be discontinued or suspended at any time or its method of computation substantially altered, the Parties shall endeavour to agree upon the substitution of the CPI with an equivalent index, or failing agreement by the parties, the substitution shall be made by a valuer appointed by the parties.
CPI Review. Where the Rent is to be reviewed to a CPI Review, the Rent on and from that Review Date is calculated as follows: R2 = R1 X PreviousCPI Where: R2 is the Rent after the Review Date; and R1 is the Rent immediately before the Review Date (disregarding any abatements incentives or reductions).
CPI Review a) Where this Agreement contemplates the Supplier providing services on an ongoing basis (such as Platform Services, licensing, hosting or support services), or if the Proposal otherwise refers to increases in the Charges according to CPI, then the Charges for each Invoice Cycle will be the higher of:
(i) an amount calculated at the start of each Invoice Cycle by the CPI Review; or
(ii) the Charges payable for the last concluded Invoice Cycle.
b) In this clause
CPI Review. 4.2.1 In this clause:
CPI Review. 5.2.1 Where the Review Method for any Review Date is CPI, the Rent on and from that Review Date is calculated as follows: R2 = R1 × Current CPI Previous CPI Where: R2 is the Rent on and from the Review Date; and R1 is the Rent immediately before the Review Date (disregarding any abatements incentives or reductions).
5.2.2 If the CPI is no longer published, either party may ask the President of the Institute to nominate an index which reflects the rate of price change in the area and group for the CPI and ‘CPI’ then means that index. Each party must pay one half of the President’s costs for nominating an index.
CPI Review. A licence fee review based on CPI will increase the amount of Licence Fee payable during the immediately preceding period by the percentage of any increase in CPI having regard to the quarterly CPI published immediately prior to the later of the Commencement Date or the last Licence Fee Review Date as the case may be and the quarterly CPI published immediately prior to the relevant Licence Fee Review Date. If there is a decrease in CPI having regard to the relevant CPI publications the Licence Fee payable from the relevant Licence Fee Review Date will be the same as the Licence Fee payable during the immediately preceding period. Should the CPI be discontinued or suspended at any time or its method of computation substantially altered, the parties shall endeavour to agree upon the substitution of the CPI with an equivalent index, or failing agreement by the parties, the substitution shall be made by a Valuer appointed in accordance with clause 6.4.
CPI Review. 3.5.1. If Item 7 of the Schedule provides for a CPI licence fee review, the Commonwealth may review the Licence Fee on each Licence Fee Review Date, using the following formula: R2 = C1 Where: R2 = the reviewed Licence Fee; R1 = the Licence Fee at the date immediately preceding the relevant Licence Fee Review Date; C1 = for the first review, the Index Number of the quarter ending immediately prior to the Commencement Date or, for any subsequent review, the Index Number for the quarter ending immediately prior to the last Licence Fee Review Date; and C2 = the Index Number for the quarter ending immediately prior to the Licence Fee Review Date.
3.5.2. For the purpose of this clause, "Index Number" means:
3.5.3. The Contractor acknowledges and agrees that, without limiting clause 10.7 of the Contract, the Commonwealth may access the Licensed Area at any time for the purposes of:
a. the Consumer Price Index (All Groups) relevant to the location of the Base ("relevant location") published from time to time by the Australian Bureau of Statistics; and
b. if there is any suspension or discontinuance in the publication of the Consumer Price Index, then until publication of the Consumer Price Index is resumed, some other index reflecting fluctuations in the cost of living in the relevant location:
(i) upon which the parties agree; or
(ii) failing agreement, determined by the Regional Manager DSG as reflecting fluctuations in the cost of living in the relevant location The decision of the Regional Manager DSG shall be final and binding upon the parties. In making the determination the Regional Manager DSG shall be deemed to be acting as an expert and not as an arbitrator.
3.5.4. If the amount of the reviewed Licence Fee is not ascertained by the CPI review date, the Contractor shall:
a. pending ascertainment, continue to pay the instalments of the Licence Fee applicable prior to the Licence Fee Review Date but subject to the revision; and
b. upon the reviewed Licence Fee being ascertained, pay any necessary adjustment of the Licence Fee calculated from the Licence Fee Review Date within thirty (30) days of demand being made by the Commonwealth.
CPI Review. If item 0 of Schedule 1 provides for a CPI adjustment the Rent for the next Review Period will be calculated in accordance with the following formula: where: A is the adjusted Rent for the next Review Period. B is the annual Rent paid by the Tenant just prior to the relevant Rent Review Date before adjustment.
