Any changes will be immediate and implemented independent of any CPI Review Date.
If the Charges have not been increased in the previous 12 months in accordance with clause 8.1, the Charges will be increased annually on the relevant CPI Review Date and the increase will apply to all subsequent payment instalments.
On and from each CPI Review Date the Rent is changed by the CPI Rate.

If a CPI Review Date is specified in Item 10, the Rent on the CPI Review Date will be adjusted to an amount equal to the Rent payable immediately before the CPI Review Date multiplied by the Current CPI and added to the Rent payable immediately before the CPI Review Date.
If the Rent to apply from any CPI Review Date is not determined before that date, then: until it is determined, the Tenant must continue paying instalments of Rent at the rate applicable before the relevant CPI Review Date; and within 14 days after the reviewed Rent is determined, the Tenant must pay any shortfall for the period from the relevant CPI Review Date until the date on which the next instalment of Rent is due to be paid.
Subject to the Retail Act, if a CPI Review Date is specified in Item 8, the Rent on the CPI Review Date will be adjusted to an amount equal to the Rent payable immediately before the CPI Review Date multiplied by the Current CPI and added to the Rent payable immediately before the CPI Review Date.
The parties agree that in any event the Rent following a CPI Review Date shall never be less than the Rent payable immediately prior to the CPI Review Date.
