Common use of Criticism Clause in Contracts

Criticism. If any employee believes that his/her supervisor or administrator has inappropriately criticized him/her in the presence of students, parents, or other employees, the employee will comply with the following procedure: Step I. An employee must first discuss the situation with the immediate supervisor or administrator who the employee believes inappropriately criticized him/her; Step II. If no resolution is reached at that level, the employee may discuss the matter with the Superintendent; Step III. If the problem is not resolved at Step Il, the employee may discuss the situation with the Board at the next available Board meeting. The resolution of the Board will be final and binding; Step IV. If the situation involves the Superintendent, then the employee may discuss the situation with the Board, after completing Step I. Failure to follow this process can result in a grievance. The only issue subject to the Grievance Procedure is whether or not the procedure established above was followed. The Board's decision will be final and binding on the parties and not subject to review through arbitration or statutory administrative hearings.
