Common use of Daily Overtime Clause in Contracts

Daily Overtime. Work in excess of eight (8) hours per day or shift, (but less than twelve [12] hours per day or shift) shall be paid at one and one-half (1½) times the employee’s straight time hourly rate. Work in excess of twelve (12) hours per day or shift shall be paid at two (2) times the employee’s straight time hourly rate. A day is defined as that twenty-four (24) hour period commencing at midnight.

Daily Overtime. Work An Employee required to work in excess of eight (8) hours per on a scheduled work day or shift, (but less than twelve [12] hours per day or shift) shall be paid for the first three (3) hours of overtime at one time and one-half (1½1 ½ X) times and for all hours worked thereafter at double time (2X), in each case based on the employeeEmployee’s straight regular straight-time hourly rate. Work that is performed in excess of seven (7) or eight (8) straight-time hours per day or shiftin a workday, (but less than twelve [12] hours per day or shift) as applicable, shall be paid at one the rate of time and one-half (1½1.5x) times for the employee’s straight time hourly rate. Work in excess of twelve first three (123) hours per day or shift shall be paid at two and double time (22x) times the employee’s straight time hourly rate. A day is defined as for all additional work performed on that twenty-four (24) hour period commencing at midnightworkday thereafter.
