DATA PROCESSOR OBLIGATION. The Data Processor processes the Personal Data for the sole purpose of the Contract and in accordance with the Data Controller documented instructions. The Data Processor declares to keep a data processing record about all categories of processing activities carried out on behalf of the Data Controller including the information required under the GDPR. If the Data Processor considers that an instruction constitutes a breach to the GDPR or to any other provision of Union or Member State law relating to data protection, it shall immediately inform the Data Controller. The Data Processor ensures that the authorized persons in charge of processing the Personal Data respect confidentiality or are subject to a relevant confidentiality obligation. It also ensures that such persons receive the necessary awareness on Personal Data protection and that they take into account the principles of data protection by design and data protection by default. , when performing the services, The Data Processor shall implement appropriate technical and organizational measures to ensure a level of security corresponding related to the risk associated with the processing, in accordance with HARDIS Information Systems Security Policy. Depending on the nature of the processing and to the extent possible, the Data Processor shall assist the Data Controller to implement appropriate technical and organizational measures and to fulfil its obligations. The Data Processor shall also assist the Data Controller to fulfil its obligation to respond to requests made by data subjects in order to exercise their rights. In this respect, the Data Processor will forward the requests received directly to the Data Controller If the Data Processor is obliged to carry out a transfer of Personal Data to a third country or to an international organization, under the law of the European Union or the law of the member state, it shall inform the Data Controller of such legal obligation prior to the processing, unless the applicable law prohibits such information for important reasons of public interest. Lastly, the Data Processor assists the Data Controller to ensure compliance with the obligations set out in Articles 32 to 36 of the GDPR, taking into account the nature of the processing and the information available to the Data Processor.
