LESSOR OBLIGATIONS. 3.1 The Lessor shall furnish to the Lessee and pay the cost of the following: a) Heating, mechanical ventilating, cooling, and humidification system capable of providing a temperature range of 68°F to 78°F, measured at 30" above the finished floor, and 12" inside any exterior wall, and a humidification range of 30% to 50%, at all times occupied. Ventilation in restrooms shall be a minimum of 100 cfm, exhausted to the outdoors. b) Electrical power distribution system throughout the Leased premises, for the operation of all business machinery and equipment. c) Natural and/or artificial interior illumination that provides a minimum 50 foot-candles, measured at desk level, at all times, throughout the Leased premises. Artificial illumination shall be by incandescent or fluorescent lamps, and shall include tubes, bulbs, starters, ballasts, and fuses used inside the illumination fixture, and the replacement thereof for the Leased premises and common areas. d) Domestic plumbing system to restrooms and break rooms capable of supplying hot and cold water, and removing sanitary waste water. Hot water delivery shall be not more than 120°F and not less than 110°F, measured at the tap. e) Potable water shall meet the requirement of the Safe Drinking Water Act, 1976 PA 399, as amended, MCL 325.1001 et seq. f) Metered utility costs for electricity, natural gas, water, sewerage, steam, fuel oil, or coal. g) Adequate roof, vertical, and foundation thermal insulation in accordance with applicable codes. h) Complete moisture protection from all exterior weather sources, on all sides, floors, and roof of the Leased premises. i) Sound attenuation between any mechanical system or other tenant in the premises and the Leased premises, which provides not greater than 45dbA sound level readings, under conditions with all Lessee business equipment shut down. j) Vibration isolation between any mechanical, plumbing, electrical, or other building system attached to and a part of the Leased premises. k) Any equipment, portable or fixed, including alarm notification systems, required by the local public fire marshal authority. l) Commercial grade, heavy-duty locking hardware. Prior to Lessee possession, all doors providing access to the Leased premises shall be rekeyed and two (2) keys per lock combination shall be provided to the Lessee. m) Pest control, including but not limited to: insects, rodents, flying animals, etc. Spraying must be performed after business hours or on weekends. n...

LESSOR OBLIGATIONS. The Lessor agrees: A. to maintain in good and safe working order the electrical, plumbing, sanitary, heating, and other facilities and appliances supplied by the Lessor; B. To maintain and make all repairs within the premises; C. To collect rents; and D. To comply with all applicable local and state laws, codes and rules.
LESSOR OBLIGATIONS. (i) The Lessor Obligations shall be secured by the following: (A) An Assignment of Lease Agreement and Purchase Agreement in the form of Exhibit J, duly executed by Lessor (the "Assignment of Lease"); (B) A Construction Deed of Trust with Assignment of Rents, Security Agreement and Fixture Filing in the form of Exhibit K, duly executed by Lessor (the "Lessor Deed of Trust"); and (C) A Security Agreement in the form of Exhibit L, duly executed by Lessor (the "Lessor Security Agreement"). (ii) Lessor shall deliver to Agent such additional mortgages, deeds of trust, security agreements, pledge agreements, lessor consents and estoppels (containing appropriate mortgagee and lender protection language) and other instruments, agreements, certificates, opinions and documents (including Uniform Commercial Code financing statements and fixture filings and landlord waivers) as Agent may reasonably request to (A) grant, perfect, maintain, protect and evidence security interests in favor of Agent in Lessor's rights in the Property Collateral and Cash Collateral; and (B) otherwise establish, maintain, protect and evidence the rights provided to Agent in the Property Collateral and Cash Collateral. Lessor shall fully cooperate with Agent and perform all additional acts reasonably requested by Agent to effect the purposes of this Subparagraph 2.11(b). (iii) Lessee hereby consents to the Assignment of Lease, the Lessor Deed of Trust and the Lessor Security Agreement; the Liens granted to Agent therein; and all other Liens granted to Agent in any of the Operative Documents and the Property to secure the Lessor Obligations.
LESSOR OBLIGATIONS. Lessor, at Lessor’s sole expense, shall keep in good order, condition, and repair, the building and other improvements in which the Premises are located, including the foundations, exterior walls, unexposed electrical, plumbing, and sewage systems, including, without exception, those portions of the system lying outside the Premises, window frames, gutters, down spouts, HVAC systems, elevator, and the exterior roof of the Premises and the building. Lessor shall also be solely responsible for repairs which relate to or arise out of: A. Structural or other latent defects in or to the Premises or the building; B. Violations of ordinances, laws, regulations and orders of authorities applicable to the construction or structure of the Premises, or Lessor’s building, except to the extent caused by Xxxxxx’s use or occupancy of the Premises; C. The negligence or intentional act of the Lessor, its employees, agents, or contractors; D. Any breach by Lessor of any of the conditions, terms, or obligations on Lessor’s part to be observed or performed under this Lease, or E. Causes outside the Premises over which the Lessee has no control. Lessee shall Lessor (as specified in 12.1 of this Lease) of any repairs required of Lessor under this paragraph. Lessor shall have thirty (30) days after written notice from Lessee to commence to perform its obligations to make repairs under this section, or to respond to the complaint in written form, except that Lessor shall commence performance of such obligations immediately after such notice if the nature of the problem presents a hazard, emergency, or substantial interference with Xxxxxx's conduct of its service to the public. Lessor shall diligentlypursue such repairs to completion once commenced. If Lessor fails to perform its obligations to immediately repair or cure a problem which presents a hazard, emergency, or substantial interferencewith Xxxxxx's conduct of its services to the public after thirty (30) days written notice of such defect, Lessee may terminate the Lease and be released from all obligations thereunder. If Lessor does not otherwise perform its obligations in compliance with this paragraph, or Lessor does not show reasonable due diligence to comply, Lessee may, in its discretion perform such obligations (subject to all necessary building codes and permits) and shall then have the right to be reimbursed for the sum of actual expense in the performance of the Lessor's obligations. LESSOR OBLIGATIONS. A. Lessor will provide to Lessee from the Arizona Department of Environmental Quality a letter indicating successful closure of the wastewater treatment plant previously located on the Property. X. Xxxxxx will assist in the applications for and processing of any necessary building permits and land use or zoning actions. X. Xxxxxx agrees in concept, subject to required legal processes, to the placement of signage, including digital displays, on authorized locations(s) proximate to the Property and adjacent to Highway 95.
LESSOR OBLIGATIONS. The Lessor agrees: A. To maintain in good and safe working order the electrical, plumbing, sanitary, heating, and other facilities including landscaping and appliances supplied by the Lessor; B. To provide actual relocation expenses up to $750 to the Tenant or lawful occupant in the event of casualty making the premises uninhabitable. This payment shall be Lessor’s sole obligation to Lessee or Lawful Occupant unless the cause of the casualty making the premises uninhabitable is the result of Xxxxxx’s intentional misconduct. In the event of such a casualty, this lease shall immediately terminate upon written notice being sent to Tenant, at the sole discretion of Lessor. C. To maintain and make all repairs within the premises; D. To collect rents; and E. To comply with all applicable local and state laws, codes and rules. F. Remove trash and snow as necessary. G. Laundry facilities are available to Lessee(s) when in proper condition and working order. All such facilities are subject to close without notice by Lessor for any reason.

LESSOR OBLIGATIONS. Lessor hereby agrees with Lessee that during the Term, it shall: 7.1 ensure that the Aircraft is operative and duly maintained according to FAA and/or ANAC standards, provided that the Aircraft may need to be grounded for a (cumulative) maximum of one (1) day per each fifteen (15) days of availability hereunder, for technical necessities. 7.2 provide spares and support equipment for maintenance of the Aircraft and, in general, shall ensure that the Aircraft shall always be in conformity with and ready to provide the Services. 7.3 be responsible for all flight and ground operations and activities of the Aircraft. Lessee agrees to render assistance and logistics support as necessary. 7.4 not cause or permit the Aircraft to be operated in any manner contrary to the operating limitations set forth in the Aircraft’s flight manual or any part thereof or any recommendation or regulation of the applicable aviation authorities. 7.5 comply with the legal requirements of the Brazilian and U.S. and/or other aviation authorities (including without limitation, any country to, from or over which the Aircraft may be flown in accordance with this Agreement). 7.6 Assist Lessee with all requested paper work and legal formalities required for the Aircraft, aircraft parts, and Lessor personnel for the purpose of maintaining, training crewing or repair of the aircraft.
LESSOR OBLIGATIONS. THE LESSOR is obliged to maintain the appropriate administrative authorisations so that the property in this contract can be inhabited, meeting that laid down in the Sixth Clause.
