DBE Good Faith Effort Sample Clauses
DBE Good Faith Effort. Pursuant to the good faith efforts described in APPENDIX C, the Borrower shall make a good faith effort to promote fair share awards to Minority Business Enterprises (“MBE”), Women's Business Enterprises (“WBE”), and Small Businesses in Rural Areas (“SBRA”) on all contracts and subcontracts awarded as part of the Project. The Borrower agrees to include, in its contract(s) with its prime contractor(s), the following language, which must not be altered in any way: “The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.” The Borrower also agrees to include, in its contract(s) with its prime contractor(s), and shall cause each contract awarded by its prime contractor(s) to include, language to the following effect (the exact language may vary):
(1) A prime contractor must pay its subcontractor(s) no more than 30 days from the prime contractor’s receipt of payment from the Borrower.
(2) The Borrower must be notified in writing by its prime contractor prior to any termination of a DBE subcontractor for convenience by the prime contractor.
(3) If a DBE subcontractor fails to complete work under the subcontract for any reason, the prime contractor must employ the Six Good Faith Efforts as described in 40
(4) A prime contractor must employ the Six Good Faith Efforts even if the prime contractor has achieved its Fair Share Objectives under Subpart D of 40 C.F.R. Part 33.
DBE Good Faith Effort. Hard Rock Sawing & Drilling, a certified MBE, is a subcontractor for this Project, and was awarded a contract in the amount of $3,000. The municipality and prime contractors made good-faith efforts to utilize DBEs in this project by encouraging DBEs to submit bids in the advertisement for bids.
DBE Good Faith Effort. The Municipality and its prime contractor made good faith efforts to obtain DBE participation in the Project. The Municipality through its bid advertisement encouraged DBEs to submit bids for the prime contract. The prime contractor made multiple direct contacts to DBEs and placed advertisements for DBE participation in the Project in two different appropriate media sources. However, no DBEs are being utilized on the Project.
DBE Good Faith Effort. The Municipality and Xxxxxx Excavating, Inc. made a good faith effort to solicit for DBEs at all levels of contracting and subcontracting through bid advertising and direct solicitation through the DBE Unified Certification Program lists. The following DBE firms are anticipated to be utilized for this Project: Xxxxxxx Construction Corporation, Hard Rock Sawing and Drilling Specialists Co, and X.X. Xxxxxx Contractor Services LLC.
DBE Good Faith Effort. The Village of Xxxxxxxx and its prime contractor, Xxxx’x Excavating & Trenching, Inc., made a good-faith effort in soliciting DBEs for this Project. This Project does not include DBE participation.
DBE Good Faith Effort. The Municipality made a good faith effort by encouraging DBEs to prequalify in the request for qualifications and encouraging DBEs to submit bids in the bid advertisement for each construction contract. The prime contractors Xxxxxx Excavating (contracts 23007-6 and 23035-6), Van Rite Plumbing (contracts 23008-6 and 23048-6), and Essential Sewer and Water Services (contract 23050-6), made good faith efforts by reaching out directly to DBEs on the Unified Certification Program list. No DBEs are anticipated to perform work on this Project.
DBE Good Faith Effort. The City of Ashland made a good faith effort to solicit DBE participation for this Project by publishing an advertisement that encouraged DBEs to apply. No evidence has been provided to the Department that indicates the prime contractor, Xxxxxxx Corporation, made good faith efforts to solicit DBE participation. Only one subcontractor was hired to perform a spot repair of sanitary sewer located in Highway 2, in order to create continuous pipe to allow CIPP lining. Given that Xxxxxxx Corporation did not solicit DBE participation for this subcontract and did not provide any other DBE opportunities in the construction contract, the Department sanctioned 7% of the costs of the subcontract, or $4,118.
DBE Good Faith Effort. The Municipality and prime contractors solicited DBE’s through advertising. No DBE’s are being utilized on this Project.
