DECISION RATIONALE. At the present time, some NRC requirements for terminating a license are specified in the regulations, but others are implemented on an individual case basis. In particular, current regulations in 10 CFR Parts 30, 40, and 70 do not specifically address licensee responsibility for nuclear materials at the time of, or following, expiration of licenses or describe procedures for termination of licenses. In some cases licensees have failed to notify the Commission of their intent to terminate operations, allowed; licenses to expire, and vacated premises before the staff had opportunity to inspect the premises for residual radioactive contamination. This situation has the potential for
