Default During Design and Construction. In the event of default of Concessionaire during the design or construction period of any additions hereunder, the Board shall have the right, which right shall be set forth in all contracts between Concessionaire and its independent contractors and suppliers for work or materials relating to additions hereunder, to replace Concessionaire with itself and to continue the contracts of Concessionaire with said independent contractors and suppliers. A provision substantially similar to the following shall comply with this Section: "The Board of Directors of the Dallas/Fort Worth International Airport, acting for the Cities of Dallas and Fort Worth (and herein referred to as the "Board"), shall have the right, but not the obligation, in the event that the Board elects to replace Concessionaire with itself under the terms of the Board's contract with Concessionaire, to continue this contract between Concessionaire and contractor, upon assuming in writing all the liabilities of Concessionaire under this contract between Concessionaire and contractor; and Board thereby shall receive all the rights, title, interests and remedies that Concessionaire has under the terms of this contract between Concessionaire and contractor. The Board shall have the right to demand, collect (including suit for damages and cost of litigation and reasonable attorney fees) from Concessionaire all costs incurred by the Board in assuming the obligations of Concessionaire as provided in this Section."

Default During Design and Construction. In the event of default by Concessionaire Tenant during the design or construction period of any Approved Project, City shall have the right, but not the obligation, following written notification to Concessionaire Tenant, to perform any work Concessionaire Tenant shall have failed to construct in accordance with Concessionaire Tenant’s Approved Project plans at Concessionaire Tenant’s sole cost and expense. City shall have the right, which right shall be set forth in all contracts between Concessionaire Tenant and its contractors and suppliers for work or materials relating to any Approved Project, to replace Concessionaire Tenant with itself and to continue the contracts of Concessionaire Tenant with said independent contractors and suppliers. City shall not be required to give any advance notice if, in City's sole and absolute judgment, City's action above is necessary to remediate a dangerous condition at the Premises which is a potential hazard to Concessionaire Tenant, Concessionaire Tenant's employees or agent, other tenants of the Airport or the public or that the Premises does not comply with the requirements of this Concession Lease.
Default During Design and Construction. Prior to the commencement of any construction of alterations/modifications on the Premises exceeding $10,000 (Ten Thousand Dollars), Lessee or Lessee’s Contractor shall provide the Authority with payment and performance surety acceptable to the Authority, equal to the full amount of the written construction contract.

  • Design and Construction In complying with the requirements of the specification both with respect to arrangement and detail, design is to conform to the best current engineering practice. Each of the several parts of the material is to be of the maker’s standard design provided that this design is in general accordance with the specification. The essence of design should be simplicity and reliability in order to give long continuous service with high economy and low maintenance cost. Particular attention should be paid to internal and external access in order to facilitate inspection, cleaning and maintenance. The design dimensions and materials of all parts are to be such that they will not suffer damage as a result of stresses under the most severe conditions. Fully detailed specifications of the several parts of the material are to be submitted describing particularly the materials to be used. The materials used in the construction of the material are to be of the highest quality and selected particularly to meet the duties required of them. Mechanisms are to be constructed to avoid sticking due to rust or corrosion. Workmanship and general finish are to be of the highest class throughout. All similar parts of the material are to be interchangeable. All equipment is to operate without undue vibration and with the least possible amount of noise and is not to cause a nuisance. All equipment is to be designed to minimize the risk of fire and any damage, which may be caused in the event of fire. The equipment is also to be designed to prevent ingress of all vermin, accidental contact with live parts and to minimize the ingress of dust and dirt. The use of materials, which may be liable to attack by termites or other insects, is to be avoided.

  • ADDITIONAL CONSTRUCTIONS The Promoter undertakes that it has no right to make additions or to put up additional structure(s) anywhere in the Project after the building plan has been approved by the competent authority(ies) except for as provided in the Act.
