Definition of East VillageTALUS Project Buildout. As described in Table 1 of Exhibit H-3, the balance of development in the East VillageTALUS Project after Phase I, up to the maximum of Allowable Development, is presently projected to consist of 300,000 additional Gross Square Feet of East VillageTALUS Project commercial office space, 50,000 Gross Square Feet of East VillageTALUS Project retail space, and 735 additional residential units. As with East VillageTALUS Project Phase I, because of changing market conditions and the actual development makeup of Phase I, the precise number of residential units in each density category, and the precise amount of commercial Gross Square Feet, actually to be developed after East VillageTALUS Project Phase I likewise cannot be known at present. Accordingly, in order to afford the Master Developer reasonable flexibility in developing the East VillageTALUS Project, the term “East Village“TALUS Project Buildout” as used in this Appendix H shall initially mean and refer to the kinds and amounts of land uses set forth in Table 1 of Exhibit H-3 for the balance of the East VillageTALUS Project after Phase I but shall also mean and refer to any amount of commercial office or retail Gross Square Feet and any number of residential units developed in the East VillageTALUS Project after Phase I that, together with Phase I, (i) do not exceed the Buildout Trip Ceiling, as defined below, and (ii) do not exceed the Allowable Development for the East VillageTALUS Project, in accordance with Section 9 (Allowable Development) and Section 10 (Conversion of Commercial to Residential) of this Agreement. As used in this Appendix H, “the Buildout Trip Ceiling” shall mean peak-hour trips projected for Buildout of the East VillageTALUS Project by a licensed transportation engineer, with the concurrence of the City, of not more than 603 p.m. peak-hour trips in to the East VillageTALUS Project and not more than 866 p.m. peak-hour trips out of the East VillageTALUS Project, for a total of not more than 1,469 p.m. peak-hour trips in and out for the entire East VillageTALUS Project (i.e., Phase I and the balance of development thereafter); provided, however, that “the Buildout Trip Ceiling” may include a projected increase of not more than 10% in either ceiling of 603 p.m. peak-hour trips in or of 866 p.m. peak-hour trips out of the East VillageTALUS Project, so long as the total projected number of p.m. peak-hour trips in and out of the East VillageTALUS Project Buildout does not exceed 1,469 p.m...

  • PREVAILING WAGE RATES - PUBLIC WORKS AND BUILDING SERVICES CONTRACTS If any portion of work being Bid is subject to the prevailing wage rate provisions of the Labor Law, the following shall apply:

To prevent any misunderstanding regarding the seriousness of these and similar acts, Form FHWA-1022 shall be posted on each Federal-aid highway project (23 CFR 635) in one or more places where it is readily available to all persons concerned with the project: 18 U.S.C. 1020 reads as follows: "Whoever, being an officer, agent, or employee of the United States, or of any State or Territory, or whoever, whether a person, association, firm, or corporation, knowingly makes any false statement, false representation, or false report as to the character, quality, quantity, or cost of the material used or to be used, or the quantity or quality of the work performed or to be performed, or the cost thereof in connection with the submission of plans, maps, specifications, contracts, or costs of construction on any highway or related project submitted for approval to the Secretary of Transportation; or Whoever knowingly makes any false statement, false representation, false report or false claim with respect to the character, quality, quantity, or cost of any work performed or to be performed, or materials furnished or to be furnished, in connection with the construction of any highway or related project approved by the Secretary of Transportation; or Whoever knowingly makes any false statement or false representation as to material fact in any statement, certificate, or report submitted pursuant to provisions of the Federal-aid Roads Act approved July 1, 1916, (39 Stat. 355), as amended and supplemented; Shall be fined under this title or imprisoned not more than 5 years or both."

  • Premises Building Project and Common Areas 1.1 Premises, Building, Project and Common Areas.

  • Construction Progress Schedule A schedule indicating proposed activity sequences and durations, milestone dates for receipt and approval of pertinent information, preparation, submittal, and processing of Shop Drawings and Samples, delivery of materials or equipment requiring long-lead time procurement, and proposed date(s) of Material Completion and Occupancy and Final Completion. The schedule will be developed to represent the sixteen or seventeen CSI Specification Divisions. It shall have a minimum number of activities as required to adequately represent to Owner the complete scope of work and define the Project’s critical path and associated activities. If the Project is to be phased, then each individual Phase should be identified from start through completion of the overall Project and should be individually scheduled and described, including any Owner’s occupancy requirements and showing portions of the Project having occupancy priority. The format of the schedule will have dependencies indicated on a monthly grid identifying milestone dates such as construction start, phase construction, structural top out, dry-in, rough-in completion, metal stud and drywall completion, equipment installation, systems operational, Material Completion and Occupancy Date, final inspection dates, Punchlist, and Final Completion date.

  • Enterprise Information Management Standards Grantee shall conform to HHS standards for data management as described by the policies of the HHS Office of Data, Analytics, and Performance. These include, but are not limited to, standards for documentation and communication of data models, metadata, and other data definition methods that are required by HHS for ongoing data governance, strategic portfolio analysis, interoperability planning, and valuation of HHS System data assets.
