Common use of Definition of Holiday Pay and Qualifiers Clause in Contracts

Definition of Holiday Pay and Qualifiers. (Article 16.02 applies to full-time employees only) Holiday pay will be computed on the basis of the employee’s regular straight time hourly rate of pay times the employee’s normal daily hours of work. In order to qualify for holiday pay for any holiday, as set out in the Local Appendix, or to qualify for a lieu day an employee must complete her scheduled shift on each of the working days immediately prior to and following the holiday except where the absence on one or both of the said qualifying days is due to a satisfactory reason. An employee who was scheduled to work on a holiday, as set out in the Local Provisions Appendix, and is absent shall not be entitled to holiday pay or to a lieu day to which she would otherwise be entitled unless such absence was due to a satisfactory reason. An employee who qualifies to receive pay for any holiday or a lieu day will not be entitled, in the event of illness, to receive sick pay in addition to holiday pay or a lieu day in respect of the same day.
