Definition of Variation. 12.1 The term “Variation” means the alteration or modification of the design, quality or quantity of the Sub-Contract Works including: 12.1(a) the addition, omission or substitution of any work; 12.1(b) the alteration of the kind or standard of any materials and goods to be used in the Sub-Contract Works; 12.1(c) the removal from the Site of any work executed or materials and goods brought thereon by the Sub-Contractor for the purposes of the Sub-Contract Works other than work, materials and goods which are not in accordance with the Sub-Contract; and 12.1(d) any changes to the provisions in the Sub-Contract with regards to: 12.1(d)(i) any limitation of working hours; 12.1(d)(ii) working space; 12.1(d)(iii) access to or utilisation of any specific part of the Site; and 12.1(d)(iv) the execution and completion of the work in any specific order, and 12.1(d)(v) the execution of temporary works, but shall exclude any changes intended to rectify any negligence, omission, default and/or breach of contract by the Sub-Contractor and such changes shall be executed by the Sub-Contractor entirely at his own cost.

Definition of Variation a. Grantor ULB, Participating ULBs or the Concessionaire may require the provision of additional works and services, which are not included in the scope of the Project or the reduction in the works and services from the scope of Project as contemplated by this Agreement (the “Variation”). Any such Variation shall be made in accordance with the provisions of this Clause 12, and the resultant costs shall be expended by the Concessionaire and reimbursed to it by Grantor ULB and Participating ULBs subject to and in accordance with this Clause 12. Provided, however, should the Concessionaire or Grantor ULB or Participating ULBs propose any change in the design that does not adversely affect the Standards and Specifications, such change shall be deemed not to be a Variation of the works and such change shall be undertaken in accordance with Clause 12.2.
