Delivery Timing. The Contractor shall maintain a delivery timing rate of 95% or greater. On-time delivery is defined as delivery within two business days for orders placed by 4:00 PM ET. The delivery timing rate is calculated by the total number of orders delivered within 2 days divided by the total number of orders. Example: 99 orders delivered within 2 days/100 total orders = 99.0% on-time delivery. The Contractor shall submit to the Department the monthly report in Microsoft Excel that details the on-time delivery timing rate.

If and whenever AMGAS becomes aware of any development or circumstance that is expected to affect the delivery date, it will notify Customer of same as soon as reasonably practicable. As the time for delivery of the Equipment approaches AMGAS will contact Customer to coordinate delivery. If Customer fails to take delivery of the Equipment when it is first made available for delivery, AMGAS will be entitled to charge Customer reasonable storage and handling charges.

Delivery Timing. NCR and Solectron will work together to ensure *** order delivery flexibility. A maximum of *** late shall be allowed for all deliveries, unless NCR specifically requests other delivery terms. Provided that Solectron is the sole cause of any delay, Solectron will *** any late Products or Parts at *** charge to NCR. Provided NCR is not the sole cause of any delay, if Solectron is unable, for any reason, to supply any portion of NCR’s requirements of the Products or Parts as established by Purchase Orders, such portion will be *** from Solectron for purposes of determining *** when *** by NCR. This will not, however, limit any NCR Agreement # other remedy to which NCR may be entitled on account of Solectron’s inability to supply NCR’s requirements.
Delivery Timing. Adolor shall give timely advance notice to GSK of its inability to make Products available as required by any Firm Order or otherwise perform its obligations under this Agreement.

Delivery Timing. Delays or failure to make a Patch available due to a force majeure event shall not constitute a Corium default. Corium will give notice to Adolor within five (5) days of Corium learning that it will be unable to make Patches available as required by any Purchase Order or otherwise perform its obligations under this Agreement due to a force majeure event .
