Department of Transportation Participation a. The services described in this Agreement will be financed, in part, with the assistance of USDOT/FTA and NYSDOT grants. The Consultant shall be required to comply with all terms and conditions prescribed for third party contracts in the grant contract between the Department of Transportation of the United States and the County, as well as all applicable terms and conditions contained in New York State Department of Transportation grant contracts with the County. The Consultant shall, at all times, comply with all applicable FTA regulations, policies, procedures and directives, including without limitation those listed directly or by reference in the contract between the County and the Department of Transportation of the United States, as they may be amended or promulgated from time to time during the term of this Agreement. Consultant’s failure to so comply shall constitute a material breach of this Agreement. Copies of the above referenced grant contracts are available for inspection by the Consultant at the Department’s office.
