Description of Permitted Uses. A. The permitted area shall be closed to motorized non-emergency vehicular access, except as expressly permitted in this agreement or as otherwise determined by Permittee for its reasonably necessary and temporary internal uses (e.g., access for emergency vehicles, delivery vehicles, etc.). B. The permitted area shall remain open to the public for pedestrian and bicyclist use and access. C. Except for the closure under subparagraph A. preceding, Permittee’s possession and use shall be non-exclusive, at all times open to the public, and reserving to the City and the public the right to access and use of the permitted public area for lawful purposes, including constitutionally- protected conduct and speech.
Description of Permitted Uses. The following open uses shall be permitted within the Floodway District to the extent that they are also permitted in a particular Plan subarea as described in Article 4 of this CDP. A. Agricultural uses such as: General farming, pasture, truck farming, sod farming, and wild crop harvesting; B. Industrial-Commercial uses such as: Parking areas and airport landing strips; C. Public and private recreation uses not requiring permanent or temporary structures designed for human habitation, such as: Parks, golf courses, driving ranges, picnic grounds, wild life and nature preserves, shooting preserves, target ranges, trap and skeet ranges, hunting, fishing and biking areas; D. Uses substantially similar in nature to permitted uses may be allowed provided that they are consistent with the provisions of this Article; E. Structures accessory to open uses permitted in Section 7.4.2., Paragraphs A, B, C, D, and E, whether temporary or permanent, subject to submittal of building plans to the Floodplain Administra- tor, for approval in accordance with Section 7.6.5, Establishment of Floodplain Development Permit, which: 1. Will not be designed for human habitation; and 2. Will have a low flood damage potential; and 3. If permitted, will be constructed and placed on the building site so as to offer the minimum obstruction to the flow waters; a. Whenever possible, structures will be constructed with the longitudinal axis parallel to the direction of the flow of flood waters, and b. Insofar as feasible, structures will be placed so their longitudinal axis are approximately on the same line as those of adjoining structures, and 4. Will be firmly anchored to prevent the structure or building from floating away thus threatening to further restrict bridge openings and other restricted sections of the stream or river.

  • Description of Projects Services a. Project/Services to be performed by A-E shall consist of the work as specified herein and as required in Attachment A. If in the event Attachment A shall be in conflict with any provision of this Contract, the wording as set forth in Attachment A shall prevail. b.   • DESCRIPTION OF PROJECT For the Company to be eligible to earn the Maximum Credit Amount, the Company will satisfy its obligations as reflected in the following representations, which the IEDC has relied upon: A. The Company will complete the Project at the Project Location. B. The Company represents that the number of permanent, Full-Time Employees (as defined in Indiana Code § 6–3.1–13–4) from whom Indiana state income tax withholdings are retained by the State of Indiana, employed as of the Commencement Date at the Project Location, is the Base Employment Number. C. The Project will result in the creation of New Employees (as defined in Indiana Code § 6- 3.1-13-6) at the Project Location of at least the Additional Jobs Commitment. D. The average of the hourly wages, before benefits, paid to New Employees at the Project Location, will at least equal the Average Wage Commitment. E. At the discretion of the IEDC, New Employees that are paid an average wage of less than the Minimum Wage Commitment may be excluded for the purpose of calculating the credit amount. F. The Project is anticipated to involve at least the Capital Investment Amount.

  • Maintenance of Permits Seller shall maintain in existence all licenses, permits and approvals, if any, in its name necessary or reasonably appropriate to the ownership, operation or improvement of the Property.

  • Construction of Provisions Although certain provisions of this Agreement contain express language which precludes the Servicer's recovery of, or reimbursement for, expenses incurred hereunder, no inference to the contrary shall be drawn from absence of such, or similar, language in any other provision hereof regarding expenses.

  • Compliance with laws; payment of Permits/Licenses All services to be performed by Contractor pursuant to this Agreement shall be performed in accordance with all applicable Federal, State, County, and municipal laws, including, but not limited to, Health Insurance Portability and Accountability Act of 1996 (HIPAA) and all Federal regulations promulgated thereunder, as amended, and the Americans with Disabilities Act of 1990, as amended, and Section 504 of the Rehabilitation Act of 1973, as amended and attached hereto and incorporated by reference herein as Attachment “I,” which prohibits discrimination on the basis of handicap in programs and activities receiving any Federal or County financial assistance. Such services shall also be performed in accordance with all applicable ordinances and regulations, including, but not limited to, appropriate licensure, certification regulations, provisions pertaining to confidentiality of records, and applicable quality assurance regulations. In the event of a conflict between the terms of this agreement and State, Federal, County, or municipal law or regulations, the requirements of the applicable law will take precedence over the requirements set forth in this Agreement. Contractor will timely and accurately complete, sign, and submit all necessary documentation of compliance.

  • LOCATION AND DESCRIPTION OF THE PROPERTY The subject property is a single-storey terraced house bearing the postal address of Xx. 00, Xxxxxx 00/XX0, Xxxxxx Xxxxx Xxxxxxx, 00000 Xxxxxxx Xxxxx, Xxxxxx.
