DISCIPLINE/DISCHARGE. 17.01 A Shop Xxxxxxx or, in the absence of a Shop Xxxxxxx, another employee from the bargaining unit chosen by the employee being disciplined, shall be present when an employee of the bargaining unit is being given a written disciplinary notice or is being discharged. 17.02 The affected employee, the Shop Xxxxxxx who is involved, and the Union, shall be given a copy of any written disciplinary or discharge notice that is to be entered on the employee's personnel file. Said notice shall be given to the affected employee and the Shop Xxxxxxx immediately, and a copy of said notice shall be faxed or emailed to the Union office within forty-eight (48) hours. 17.03 The Co-operative agrees that any written disciplinary notices shall be removed from the employee's personnel file after eighteen (18) months. Said written disciplinary notice cannot be used against the employee at a later date. This time period of eighteen (18) months shall not include periods of layoffs, periods of leaves of absence without pay, or periods of disciplinary suspensions. It is understood that should any employee receive a written disciplinary notice for the same or similar offence during said eighteen (18) month period, the employee will then be required to wait a further eighteen (18) months before their written reprimands and/or disciplinary notices are removed from their personnel file. Notwithstanding the foregoing, written disciplinary notices involving harassment, bullying, major safety violations and/or violence will remain on the employee’s file indefinitely. 17.04 Employees covered by this Agreement will have access to their own personnel file, upon request by the employee involved. It is understood that employees shall be able to obtain copies of their personnel file when requested and an employee's reply to any document contained in their personnel file will also be placed in said employee's personnel file. DISCIPLINE/DISCHARGE. 17.01 28.01 A full-time Union Representative and/or Shop Xxxxxxx or, in the absence of a Shop Xxxxxxx, another employee from in the bargaining unit chosen by from within the employee being disciplinedunit, shall be present when an employee a member of the bargaining unit unit: (1) is being given any reprimand (verbal or written) which is to be entered on the employee's personnel file; (2) is suspended or discharged. In unusual circumstances, where it is necessary for the Employer to advise an employee by registered mail of discharge, the Union office will be sent a written disciplinary copy of such notice by email, regular mail and/or fax. In these cases, absence of a full-time Union Representative, Shop Xxxxxxx or is being dischargedanother employee shall not invalidate the discipline or discharge. 17.02 28.02 The affected employee, the Shop Xxxxxxx who is involved, and the Union, employee shall be given a copy of any written disciplinary or disciplinary/discharge notice that which is to be entered on the employee's personnel file. DISCIPLINE/DISCHARGE. 17.01 The Employer may warn, suspend, demote or discharge an employee for just cause. If the conduct or performance of an employee warrants disciplinary action, such action shall be confirmed in writing. A Shop Xxxxxxx orcopy of all such documentation shall be provided to the employee(s) involved, in and forwarded to the absence office of a Shop Xxxxxxxthe Union at the time they are issued. 17.02 Any disciplinary notice shall be issued only after, another employee from or during the bargaining unit chosen by meeting with the employee being disciplined, . An employee shall be present when an employee advised of the bargaining unit nature of the meeting prior to entering. If the employee is not at work and is not scheduled to work within three (3) days of the incident, or if the incident giving rise to the meeting is so serious that any written disciplinary notices more immediate action is warranted, she may be called in at a time when she is not scheduled, but will be paid for such time during the meeting. 17.04 Any record of discipline older than twelve (12) months shall be removed from the an employee's personnel file after eighteen ’s file, provided that there is no subsequent discipline of any reason issued during such period. 17.05 Within five (185) months. Said written disciplinary notice cannot be used against the employee at workdays following a later date. This time period of eighteen (18) months shall not include periods of layoffs, periods of leaves of absence without pay, suspension or periods of disciplinary suspensions.
