Common use of DISCIPLINE/DISCHARGE Clause in Contracts

DISCIPLINE/DISCHARGE. 25.01 A Shop Xxxxxxx, or in the absence of a Shop Xxxxxxx, another employee from the bargaining unit at the choosing of the employee being disciplined, shall be present when an employee of the bargaining unit is given a written disciplinary and/or discharged notice. A full-time Union Representative shall be entitled to attend any such meeting providing they are readily available to do so. 25.02 All disciplinary meetings shall be held in private and shall take place in a location on the Employer's premises. 25.03 The affected employee, the Shop Xxxxxxx who is involved, and the Union, shall be given a copy of any disciplinary notice which is to be entered on an employee’s personnel file. The affected employee, said Shop Xxxxxxx, and the Union, shall also be given a copy of any discharge notice that is given to an employee. In all cases of discipline or discharge the Employer shall notify the affected employee, said Shop Xxxxxxx, and the Union in writing of the exact reasons for taking such action. Any such notice of discipline and/or discharge shall be given to the affected employee and said Shop Xxxxxxx immediately, and a copy of said discipline and/or discharge notice shall be faxed or emailed to the Union Office within three (3) working days of the event. 25.04 Employees covered by this Agreement shall have access to their own personnel file, upon written request by the employee involved. Employees shall be able to obtain copies of their personnel file when requested and a copy of an employee's reply to any document contained in their personnel file shall be placed in the employee's personnel file. The Employer shall keep only one (1) personnel file per employee.

In unusual circumstances, where it is necessary for the Co-operative to advise an employee by mail of discharge, the Union office will be faxed or emailed a copy of such notice, within forty-eight (48) hours of it being issued. It is agreed that a breach of this clause does not invalidate the discipline. 16.04 The signing of disciplinary or discharge notices by Shop Stewards or employees does not mean that they are in agreement, or that they support the content of the eventdisciplinary or discharge notice, but is an acknowledgment that they have received said disciplinary or discharge notice. 25.04 16.05 Employees covered by this Agreement shall have access to their own personnel file, upon written request by the employee involved. Employees shall be able to obtain copies of their personnel file when requested and a copy of an employee's reply to any document contained in their personnel file shall be placed in the employee's personnel file. Any such notice of discipline and/or discharge shall be given to the affected employee and said the Shop Xxxxxxx Stewards immediately, and a copy of said discipline and/or discharge notice shall be faxed or emailed to the Union Office office within three twenty-four (324) working days hours of the event. 25.04 29.03 In order for a disciplinary action or discharge to be valid, a copy must be given to the Shop Xxxxxxx in the plant or, in his or her absence, a copy of such notice must be mailed to the Union office by registered mail. 29.04 The Company agrees that any discipline shall be removed from the employee's personnel file after one (1) year. Said discipline cannot be used against the employee at a later date. This time period of one (1) year shall not include periods of layoffs or periods of leaves of absence without pay. 29.05 Employees covered by this Agreement shall have access to their own personnel file, upon written request by the employee involved. Employees It is understood that employees shall be able to obtain copies photocopies of any and all documents contained in their personnel file when requested and a file. A copy of an employee's reply to any document contained in their his or her personnel file shall be placed in the employee's personnel filefile and must be first given to the plant manager. The Employer Company shall keep only one (1) personnel file per employee.
