DISCIPLINE TOLLING PERIOD. a. In all disciplinary matters, the Agency shall issue a letter of intent to discipline within 365 days from the date of discovery of the misconduct by a person authorized to initiate an investigation of the misconduct. This time limitation shall be extended if any of the conditions referenced in California Government Code sections 3304(d)(2) or 3304(g) exist during the 365-day period. b. The Agency shall issue a closure letter to the subject employee in any case in which no disciplinary action ensues.
