DISPLAY OF ARTWORK. A. The City shall have the right to remove the Artwork from display for any reason. In addition, the City may relocate the Artwork at any time, provided that the City shall confer with the Artist on any relocation and will consider any reasonable proposal by the Artist to relocate the Artwork and permit the Artist to provide artistic supervision of such relocation. The Artist may require City to remove any attribution to Artist from the Artwork if any the City relocates less than the entire Artwork without Artist’s prior written approval. If the City elects to remove the Artwork or relocate less than the entire Artwork, the City will consider any proposal thereupon presented by the Artist for such relocation or Artist’s proposal to buy back or provide other method of disposition of the Artwork that is not relocated. The City agrees that upon notice to the Artist, the Artist shall have the right of first refusal on the sale of the Artwork or any portion thereof at fair market value, as determined by a mutually selected, independent third-party appraiser. The Artist must exercise its right of first refusal to buy back the Artwork by giving the City notice of its election within thirty (30) days after the City has given written notice to the Artist. The Artist’s failure to timely give such notice shall constitute a waiver of the Artist’s right of first refusal.

The Artist must exercise its right of first refusal to buy back the Artwork by giving the City notice of its election within thirty (30) days after the City has given written notice to the Artist. It is the current intention of the City and the Artist that the Artwork remain at this location for a minimum of five (5) years from the date of installation and acceptance of the Artwork by the City. . However, if the City desires to remove the Artwork (“Removal”), whether before or after the expiration of said five-year period, the City shall first attempt to notify the Artist, but City may remove the Artwork regardless of Artist’s recommendations at the sole discretion of the City. In addition, the City may relocate the container to which the Artwork is affixed at any time, at the sole discretion of the City. The City agrees to make reasonable efforts to confer with the Artist if the less than the entire artwork is to be relocated. The Artist may require City to remove any attribution to Artist from the Artwork if City relocates less than the entire Artwork without Artist’s prior written approval.
DISPLAY OF ARTWORK. In order to further its commitment to encourage artistic expression, to inspire a sense of civic pride, and to integrate the arts into the community, County agrees to allow Permittee to display his or her artwork in the CAC provided that Permittee complies with the terms of this Agreement and the “Conditions For Participation In The Art Halls/Art Walls Program At The San Diego County Administration Center” (the “Conditions”), which is attached hereto as Exhibit A and incorporated herein by reference.
DISPLAY OF ARTWORK. The Artist agrees to deliver the Artwork for display to FMH’s designated individual and location at a specified time and date to be determined prior to the opening of the show in accordance with Appendix A. It is agreed that the anticipated display dates set forth on Appendix A are subject to change by FMH in its sole and absolute discretion. Please also refer to Appendix A for specific requirements for the Artwork submission. The Artist shall be responsible for delivering the Artwork in “ready for hanging” condition, with the Artwork appropriately framed and fitted with wire or other hanging devices (please refer to website for framing guidelines). The specific display location of the Artwork in the Woman’s Center is also subject to FMH’s sole and absolute discretion, and FMH reserves the right, in its sole and absolute discretion, to refuse to display any Artwork it deems distasteful, objectionable, offensive, and/or not otherwise fitting or compatible with the overall nature and environment of the Woman’s Center and/or for any other reason FMH deems proper.
DISPLAY OF ARTWORK. Artwork will be on display in a location within Cedar Falls from approximately May 1, 2024 – October 27, 2024 ("Display Period").
DISPLAY OF ARTWORK. During the period of the CITY’S display of the ARTWORK, the CITY shall make the ARTWORK available for viewing by the public without charge. The CITY shall not charge any admission fee or similar fee as a condition of viewing the ARTWORK.

The specific display location of the Artwork in the 50+ Community Center is also subject to the Division’s sole and absolute discretion, and the Division reserves the right, in its absolute discretion, to refuse to display any Artwork it deems not fitting or compatible with the overall nature and environment of the 50+ Community Center.
