For Plan Years beginning on or after January 1, 2002, a Member’s Salary Deferrals, and earnings attributable to these contributions, shall be distributable on account of the Member’s severance from employment occurring after December 31, 2001. Effective as of July 1, 2002, a Member’s Salary Deferrals, and earnings attributable to these contributions, shall be distributable on account of the Member’s severance from employment regardless of when the severance from employment occurred. However, any distribution under this Subsection 12.10 shall be subject to all other provisions of the Plan regarding distributions, including but not limited to Subsection 7.3(e) of the Plan, other than provisions that require separation from service before such amounts may be distributed.
