(1) The Design Consultant shall be the interpreter of the design intent of the Construction Contract Documents, subject to the terms and conditions of the agreement between the Design Consultant and the Owner, provided, however, the Construction Manager shall request such interpretations from the Design Consultant, with Owner consent, from time to time in order to facilitate the Construction Manager’s accomplishment of its duties under this Agreement. The Owner's consent may be provided to the Construction Manager at the beginning of Part I Services and does not have to be requested on an item-to-item basis.
