Common use of Downward Reclassification of Position Clause in Contracts

Downward Reclassification of Position. ‌ (a) If an employee is reclassified to a lower rated position classification, the employee will have their wage rate frozen and will continue to be paid the rate of their old position until such time as the rate of their new position equals or exceeds the rate of their old position or if an employee is reclassified to a lower rated position due to performance reasons then the provisions of this clause do not apply. (b) The employee shall not receive any negotiated salary increases until such time as the rate of the new position equals or exceeds their frozen wage rate. (c) If an employee voluntarily requests a downward reclassification, then the provisions of this clause do not apply.
