In the whole of the circumstances, it cannot be said that the husband was induced to enter into the financial agreement by the misconduct of the wife. It is not the case here that the husband was merely suspicious of the valuation provided by the wife. As I have found above, he had a positive belief that the company would float and had received sound legal advice as to the most appropriate course for him to take. He chose not to take that advice, thereby undertaking the risk that he was wrong. The wife failed to make a full and xxxxx disclosure in accordance with the requirements of the law. Further, in some instances she has acted fraudulently within the meaning of that word in the relevant legislation. Accordingly, the husband has established a prima facie ground for the setting aside of both the consent orders and the BFA. However, the husband did not rely on either the wife's failure to make a full and xxxxx disclosure or any misrepresentation, whether fraudulent or otherwise, made by her. At all relevant times, he had competent and experienced family law solicitors acting for him and was also represented by senior counsel with a highly specialised practice in family law. The ultimate advice received by the husband was the letter dated 9 March 2004 which was extremely detailed, articulate and most competently written. The husband chose to ignore that advice. ”
