Dredging Quantity. 4.1.1 The Dredging quantity will be measured based on joint pre-dredge and post dredge surveys for various shoals which will be given by EIC / his representative regularly during working season. EIC will try to give one shoal for dredging in advance while dredging of the previous shoal is under progress in order to avoid idling of dredger, provided pre-dredge survey is not delayed on account of contractor. 4.1.2 Further, if the Contractor has been offered the quantity and contractor is unable to dredge the stipulated quantity, liquidated damages shall be applicable, as defined in Clause 8.12 of GCC.

Dredging Quantity. 4.1.1. XXXX will make all efforts to give/ assure the dredging quantity of 1,30,000 m3 for each dredger in each working season (15th October to 15th June). This quantity will be measured based on joint pre-dredge and post dredge surveys for various shoals which will be given by EIC/ his representative regularly during working season. EIC will try to give one shoal for dredging in advance (i.e. when dredging of the previous shoal is under progress) provided pre-dredge survey is not delayed on account of contractor. 4.1.2. XXXX will also give compensation to the contractor for shortage of dredging quantity (in each stretch) provided the dredging quantity given is less than 80% of 1,30,000 m3 (i.e. less than 1,04,000 m3). This compensation will be calculated on the quantity less than 1,04,000 m3 multiplied by 50% of the contract rate of dredging and limited to INR 25.00 Lakh per dredger per working season. For example, and for abundant clarity, if the quoted rate is INR 100 per m3 and quantity provided in a working season for one dredger is 94,000 m3 (or 10,000 m3 less than 1,04,000 m3) then the compensation to be paid would be 10000 m3 x INR 100 x 50% = INR 500,000/-. In the event of slow progress of work due to unsatisfactory performance of dredgers/contractor, the EIC is not able to allocate shoals resulting in less quantity of dredging, no compensation would be payable by XXXX to Contractor. 4.1.3. Further, if the contractor has been offered the quantity and contractor is unable to dredge the stipulated quantity, liquidated damages shall be applicable, as defined in Clause 8.12 of GCC.

  • Natural Gas 21.1 Subject to Article 21.2, the Indian domestic market shall have the first call on the utilisation of Natural Gas discovered and produced from the Contract Area. Accordingly, any proposal by the Contractor relating to Discovery and production of Natural Gas from the Contract Area shall be made in the context of the Government's policy for the utilisation of Natural Gas and shall take into account the objectives of the Government to develop its resources in the most efficient manner and to promote conservation measures. 21.2 The Contractor shall have the right to use Natural Gas produced from the Contract Area for the purpose of Petroleum Operations including reinjection for pressure maintenance in Oil Fields, gas lifting and captive power generation required for Petroleum Operations. 21.3 For the purpose of sales in the domestic market pursuant to this Article 21, the Contractor shall have freedom to market the Gas and sell its entitlement.

  • Contract Quantity The Contract Quantity during each Contract Year is the amount set forth in the applicable Contract Year in Section D of the Cover Sheet (“Delivery Term Contract Quantity Schedule”), which amount is inclusive of outages.

  • Delivery Point The delivery point is the point of delivery of the Power Product to the CAISO Controlled Grid (the “Delivery Point”).
