Dues Check-off and Agency Shop. A. The Employer shall deduct dues from the earnings of each LOCAL #32 member provided the employee executes a written authorization for such dues deduction, and provided LOCAL #32 furnishes said authorization to the Employer fifteen (15) days prior to the employee’s pay day. Dues will be deducted beginning the first payday after furnishing of the authorization. The Employer shall deduct from each member’s biweekly pay an amount that is approved by Local #32 from time to time in its sole discretion upon notice to the Employer. The employer shall continue to deduct said dues until an employee properly resigns as a member of the Union in accordance with the bylaws and applicable statutes as presently existing or as may be amended. LOCAL #32 shall furnish a copy of the resignation from the Union membership. B. The Employer shall deduct a representation fee in lieu of dues from each employee who is not a member of LOCAL #32 but who is covered by this Agreement in the amount of eighty-five percent (85%) of Local #32 dues as is approved by Local #32, from time to time, in its sole discretion, upon notice to the Employer. C. LOCAL #32 shall indemnify and save the Borough harmless for liabilities, including council fees, costs and damages that shall arise out of or by reason of action taken by the Borough in reliance upon dues deduction authorization cards furnished by THE UNION to the Borough or in reliance upon the official notification on the letterhead of THE UNION and signed by the President of LOCAL #32, advising of changes in dues deductions or representation fees in lieu of dues. LOCAL #32 shall not indemnify or save harmless the Employer from its own negligence concerning dues deductions. D. LOCAL #32 represents that it has in place a demand-and-return system required by Law, and that it shall advise each employee who is not a member of the Union, in writing, of the 85 percent representation fee and the demand-and –return system in effect. LOCAL #32 represents that Union memberships are available on an equal basis to all and that memberships are not awarded on a discriminatory basis. E. The Employer shall pay all dues and representation fees in lieu of dues collected on a monthly basis to LOCAL #32 by mailing same to its designated representative, together with a list of the employees and the amounts deducted for each. These sums shall be sent within five (5) days of the final pay period of the month.

Dues Check-off and Agency Shop. A. a. The Union shall have the exclusive right to the check-off and transmittal of dues on behalf of each employee. b. Any employee may consent in writing to the authorization of the deduction of dues from his or her wages and to the designation of the Union as the recipient thereof. Such consent, if given, shall be in proper form, acceptable to the Employer, bearing the signature of the employee. Section 2 The Employer agrees to an agency shop fee deduction to the extent permitted by applicable law and subject to the following conditions. a. The Union shall deduct have the exclusive right to the deduction and transmittal of the agency shop fee for the employees covered by the Agreement. LOCAL #32 represents that it has in place a demand-and-return system required by Law, and that it shall advise each employee who is not a member members of the Union, in writingaccordance with applicable law, including Title 2 USC of Section 44 (1) (b), subject to the 85 percent representation fee and the demand-and –return system in effect. LOCAL #32 represents that Union memberships are available on an equal basis to all and that memberships are not awarded on a discriminatory basis. E. The Employer shall pay all dues and representation fees in lieu development of dues collected on a monthly basis to LOCAL #32 by mailing same to its designated representative, together with a list of the employees and the amounts deducted for each. These sums mutually acceptable language which shall be sent within five (5) days of the final pay period of the monthincorporated into a Supplemental Agreement.

The Representation Fee shall be an amount up to eighty five 92 percent (85%) of the regular Union membership dues, fees, and assessments as certified to the 93 Employer by the President Union. The Union may revise its certification of LOCAL #32, advising the amount of the 94 Representation Fee at any time to reflect changes in dues deductions the regular Union membership dues, fees 95 and assessments. The Union’s entitlement to the Representation fee shall continue beyond the 96 termination date of this Agreement so long as the Union remains the majority representative of 97 the employees in the Unit, provided that no modification is made in this provision by a successor 98 agreement between the Union and the Employer. For the purpose of this provision, employees 99 employed on a ten (10) month basis or representation fees who are reappointed from year to year shall be considered 100 to be in lieu of duescontinuous employment. LOCAL #32 101 102 e. United Service Workers Union, IUJAT, Local 255 shall not indemnify or save harmless the Employer from its own negligence concerning dues deductions. D. LOCAL #32 represents that it has in place establish and maintain at 103 all times a demand-and-demand and return system required as provided by LawNJSA 34:13a-5.5(c) and 5.6, and that it shall advise each employee who is not a member of the 104 membership in United Service Workers Union, IUJAT, Local 255 shall be available to all 105 employees in writing, of the 85 percent representation fee and the demand-and –return system in effect. LOCAL #32 represents that Union memberships are available unit on an equal basis at all times. In the event United Service Workers Union, 106 IUJAT, Local 255 fails to all and that memberships are maintain such a system, or if membership is not awarded on a discriminatory basis. E. The so available, the 107 Employer shall pay all dues and representation fees in lieu of dues collected on a monthly basis to LOCAL #32 by mailing same to its designated representative, together with a list of the employees and the amounts deducted for each. The Union shall indemnify indemnify, defend and save the Borough Township harmless for liabilitiesagainst any and all claims, including council feesdemands, costs and damages suits or other forms of liability that shall arise out of or by reason of action taken by the Borough Township either in reliance upon dues the salary deduction authorization cards furnished forms submitted by THE UNION the Union to the Borough Township or in reliance upon the official notification representation fee deductions of this Article. It is specifically agreed that the Township assumes no obligation, financial or otherwise, arising out of the provisions of this Article. The Township shall be relieved from making "check-off" or representation fee deductions upon (a) termination of LOCAL #32employment, advising or (b) transfer to a job other than one covered by the bargaining unit, or (c) layoff from work, or (d) leave of changes absence, or (e) revocation of the check-off authorization in accordance with its terms or with applicable law. Notwithstanding the foregoing, upon the return of an employee to work from any of the foregoing enumerated absences, the Township will resume the obligation of making said deductions in accordance with Paragraph D hereof. F. The Township shall not be obliged to make dues deductions or representation fees in lieu fee deductions of dues. LOCAL #32 any kind from any employee who, during any dues month involved, shall not indemnify or save harmless have failed to receive sufficient wages to equal the Employer from its own negligence concerning dues deductions. If an employee is in arrears due to the Township's failure to make proper deductions, however, the Township will deduct the appropriate amount when requested and verified by the Union. D. LOCAL #32 represents that it has in place G. If a demand-and-return system required by Law, and that it shall advise each bargaining unit employee who is does not become a member of the UnionUnion during any calendar year which is covered in whole or in part by the Agreement, said employee will be required to pay a representation fee to the Union for that year. The purpose of this fee will be to offset the employee's per capita cost of service rendered by the Union as majority representative. H. Prior to the beginning of each calendar year, the Union will notify the Township in writing of the amount of the regular membership dues, initiation fees and assessments charged by the Union to its own members for that calendar year. The representation fee to be paid by non-members will be equal to 75% of that amount. 1. Once during each calendar year covered in whole or in part by this Agreement, the Union will submit to the Township a list of those employees who have not become members of the union for the then current membership year. The Township will deduct from the salaries of such employees, in writingaccordance with Paragraph I. 2., below, the full amount of the 85 percent representation fee and will transmit the demand-and –return system in effect. LOCAL #32 represents that Union memberships are available on an equal basis amount so deducted to all and that memberships are not awarded on a discriminatory basisthe Union. E. 2.
