Duration of Easement. This Warranty Easement Deed shall remain in effect until such time as the United States determines that the converted area is no longer in agricultural use or is returned to its original wetland classification with equivalent wetland functions. In the event that the Landowner believes that the conditions necessary to keep the easement in force are no longer applicable to the land, the Landowner may request a termination of this easement from the United States, which may terminate the easement if, the United States determines, in it sole discretion, that one of the above conditions for termination exists. Duration of Easement. In accordance with Texas Education Code §85.26(c), this grant is for a term of three (3) years from the Effective Date and may be renewed only at the election of GRANTOR. GRANTEE agrees to provide GRANTOR written notice requesting renewal of the term at least six (6) months prior to the expiration date of this Easement. GRANTOR will respond in writing indicating whether the term will be renewed. GRANTEE expressly understands that its continued possession of the Property under this Agreement after expiration of its term, without first obtaining a renewal from GRANTOR, is a violation of state law that subjects GRANTEE to a penalty of One Hundred Dollars ($100) for each day of such violation. GRANTEE agrees to pay GRANTOR such penalty within ten (10) business days after receipt of notice from GRANTOR sent in compliance with Section 14 of this Agreement.

Duration of Easement. 5.1 Except as otherwise provided in Section 11 of this Agreement, the Easement will commence on the Effective Date of this Agreement and continue to exist until 24 months after the date on which Grantee’s Facilities located thereon cease to be used in accordance with the Permitted Uses granted herein, at which time Grantee’s Facilities (as they may have been reconstructed, replaced, or rebuilt) shall be deemed abandoned (“Deemed Abandonment”), unless such non-use is caused by events of force majeure. The Parties recognize, however, that Xxxxxxx’s Facilities may from time to time be temporarily de-energized and taken out of service for purposes of maintenance, reconstruction, replacement, rebuilding, inspection, and system operations, and such periods of temporary de-energization shall not constitute a Deemed Abandonment and shall not operate to nullify, void, or terminate the Easement so long as the work is completed within the above- described 24 month period.
Duration of Easement. The Utility Easement shall commence on the effective date of this Agreement and shall run with the land and continue in full force and effect perpetually.
