Common use of Duty Disability Clause in Contracts

Duty Disability. (1) Except as provided in b.(2), below, employees in active service who commence receiving duty disability retirement allowance between January 1, 2018, and December 31, 2020, as such allowance is defined in Section 36.05(3) of the ERS Act or Section 35.01(50) of the City Charter, shall be entitled to the health care coverage provided in subsection 1.a., of this Article, above, between January 1, 2018, and December 31, 2020, so long as they continue to receive such duty disability retirement allowance and so long as they are under age 65. If a duty disability retiree eligible for health care coverage dies prior to attaining age 65, the duty disability retiree's surviving spouse shall be eligible for health care coverage until the last day of the month in which the deceased duty disability retiree would have attained age 65. (2) An employee in active service who commences receiving a duty disability retirement allowance of 90% of his/her current salary between January 1, 2018, and December 31, 2020, as such allowance is defined in Section 36.05(3) of the ERS Act or Section 35.01(50) of the City Charter, shall be entitled to the health care coverage provided in subsections 1.a. of this Article, above, between January 1, 2018, and December 31, 2020, so long as he/she continues to receive such duty disability retirement allowance. If a duty disability retiree eligible for health care coverage dies prior to attaining age 65, the duty disability retiree's surviving spouse shall be eligible for health care coverage until the last day of the month in which the deceased duty disability retiree would have attained age 65.

If a 24 duty disability retiree eligible for health care coverage dies prior to 25 attaining age 65, the duty disability retiree's surviving spouse shall be 26 eligible for health care coverage until the last day of the month in which the 27 deceased duty disability retiree would have attained age 65. 28 (2) An employee in active service who commences receiving a duty disability 1 retirement allowance of 90% of his/her current salary between January 1, 2 2018, and December 31, 20202019, as such allowance is defined in Section 3 36.05(3) of the ERS Act or Section 35.01(50) of the City CharterAct, shall be entitled to the health care coverage 4 provided in subsections subsection 1.a. of this Article, above, between January 1, 2018, 5 and December 31, 20202019, so long as he/she continues to receive such duty 6 disability retirement allowance. If a duty disability retiree eligible for 7 health care coverage dies prior to attaining age 65, the duty disability 8 retiree's surviving spouse shall be eligible for health care coverage until the 9 last day of the month in which the deceased duty disability retiree would 10 have attained age 65.

If a 25 duty disability retiree eligible for health care coverage dies prior to attaining 26 age 65, the duty disability retiree's surviving spouse shall be eligible for 27 health care coverage until the last day of the month in which the deceased 28 duty disability retiree would have attained age 65. 1 (2) An employee in active service who commences receiving a duty disability 2 retirement allowance of 90% of his/her current salary between January 1, 20183 2020, and December 31, 20202022, as such allowance is defined in Section 4 36.05(3) of the ERS Act or Section 35.01(50) of the City CharterAct, shall be entitled to the health care coverage 5 provided in subsections subsection 1.a. of this Article, above, between January 1, 20182020, 6 and December 31, 20202022, so long as he/she continues to receive such duty 7 disability retirement allowance. If a duty disability retiree eligible for health 8 care coverage dies prior to attaining age 65, the duty disability retiree's 9 surviving spouse shall be eligible for health care coverage until the last day 10 of the month in which the deceased duty disability retiree would have 11 attained age 65.
