Effect of Injury or Illness. If injury, illness or death prevents fulfillment of the agreement to return to service in the District, no repayment of leave salary shall be required. Both the Board of Trustees and the District shall be free from any liability for the payment of any compensation or damages provided by law for the death or injury of any unit member employed in a position requiring certification qualifications when the death or injury occurs while the unit member is on leave of absence.
