Electronic Data Security. To the extent that Business Associate creates, receives, maintains or transmits electronic Protected Health Information, Business Associate hereby represents and warrants that it:
2.17.1. Has implemented and documented administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic Protected Health Information that Business Associate creates, receives, maintains or transmits on behalf of Hybrid Entity consistent with the requirements at 45 CFR Part 164, Subpart C;
2.17.2. Will ensure that any agent, including a subcontractor, to whom Business Associate provides electronic Protected Health Information agrees to sign a business associate agreement and implements reasonable and appropriate safeguards to protect the Protected Health Information; and
2.17.3. Will keep records of all security incidents involving Protected Health Information of which Business Associate becomes aware, and will report to Hybrid Entity all significant security incidents of which Business Associate becomes aware.
Electronic Data Security. 7.1. BUSINESS ASSOCIATE shall implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic PHI that it creates, receives, maintains or transmits to or on behalf of COVERED ENTITY as required by the HIPAA Security Regulations. BUSINESS ASSOCIATE further agrees to ensure that any agent, including a subcontractor, to whom it provides such information, agrees to implement reasonable and appropriate safeguards to protect it. BUSINESS ASSOCIATE agrees to promptly report to COVERED ENTITY any material security incident of which it becomes aware.
Electronic Data Security. Business Associate agrees to implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic Protected Health Information that it creates, receives, maintains or transmits to or on behalf of Covered Entity as required by the Regulations. Business Associate further agrees to ensure that any agent, including a subcontractor, to whom it provides such information, agrees to implement reasonable and appropriate safeguards to protect it. Business Associate agrees to promptly report to Covered Entity any security incident of which it becomes aware.
Electronic Data Security. To the extent that Business Associate creates, receives, maintains, or transmits electronic Protected Health Information, Business Associate hereby represents and warrants that it:

Has implemented and documented administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic Protected Health Information that Business Associate creates, receives, maintains, or transmits on behalf of Covered Entity consistent with the requirements at 45 CFR §§ 164.306, 164.308, 164.310, 164.312 and 164.316.
2.17.2. Will ensure that any agent, including a subcontractor, to whom Business Associate provides electronic Protected Health Information agrees to sign a business associate agreement and implements reasonable and appropriate safeguards to protect the Protected Health Information; and
2.17.3. Will keep records of all security incidents involving Protected Health Information of which Business Associate becomes aware and will report to Covered Entity all significant security incidents of which Business Associate becomes aware.

To the extent that Business Associate creates, receives, maintains or transmits electronic Protected Health Information, Business Associate hereby represents and warrants that it: Has implemented and documented administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic Protected Health Information that Business Associate creates, receives, maintains or transmits on behalf of Health Plan Sponsor consistent with the requirements of the HIPAA Security Standards; Will ensure that any agent, including a subcontractor, to whom Business Associate provides electronic Protected Health Information agrees to sign a business associate agreement and implements reasonable and appropriate safeguards to protect the Protected Health Information; and Will keep records of all security incidents involving Protected Health Information of which Business Associate becomes aware, and will report to Covered Entity all significant security incidents of which Business Associate becomes aware.
Electronic Data Security. Business Associate agrees to implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of any electronic Protected Health Information that it creates, receives, maintains or transmits to or on behalf of Covered Entity as required by the Regulations. Business Associate further agrees to ensure that any agent, including a subcontractor, to whom it provides such information, agrees to implement reasonable and appropriate safeguards to protect it. Business Associate agrees to promptly report to Covered Entity any Security Incident of which it becomes aware, provided that this BAA shall constitute notice by Business Associate to Covered Entity of the ongoing existence and occurrence of attempted but unsuccessful Security Incidents including, but not be limited to, pings and other broadcast attacks on Business Associate’s firewall, port scans, unsuccessful log-on attempts, denials of service and any combination of the foregoing, so long as any such incident does not result in unauthorized access, use or disclosure of PHI or material disruption of Business Associate’s information systems.
Electronic Data Security. To the extent that Business Associate creates, receives, maintains or transmits electronic Protected Health Information, Business Associate hereby represents and warrants that it:
2.17.1. Has implemented and documented administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic Protected Health Information that Business Associate creates, receives, maintains or transmits on behalf of Hybrid Entity consistent with the requirements at 45 CFR §§ 164.306, 164.308, 164.310, 164.312 and 164.316;
2.17.2. Will ensure that any agent, including a subcontractor, to whom Business Associate provides electronic Protected Health Information agrees to sign a business associate agreement and implements reasonable and appropriate safeguards to protect the Protected Health Information; and
2.17.3. Will keep records of all security incidents involving Protected Health Information of which Business Associate becomes aware, and will report to Hybrid Entity all significant security incidents of which Business Associate becomes aware.
Electronic Data Security. To the extent that HIN sends, receives, finds, or uses electronic PHI, HIN hereby agrees that it:
2.16.1. Has implemented and documented administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic PHI that HIN sends, receives, finds, or uses on behalf of PO consistent with the requirements at 45 CFR §§ 164.308, 164.310, 164.312 and 164.316;
2.16.2. Will ensure that any agent, including a subcontractor, to whom HIN provides electronic PHI agrees to implement reasonable and appropriate safeguards to protect the PHI; and
2.16.3. Will keep records of all Security Incidents involving PHI of which HIN becomes aware, and will report to PO all significant Security Incidents of which HIN becomes aware.
Electronic Data Security. To the extent that Business Associate creates, receives, maintains or transmits electronic PHI, Business Associate hereby agrees that it:
2.17.1. Has implemented and documented administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic PHI that Business Associate creates, receives, maintains or transmits on behalf of Client consistent with the requirements at 45 CFR §§ 164.308, 164.310, 164.312 and 164.316;
2.17.2. Will ensure that any agent, including a subcontractor, to whom Business Associate provides electronic PHI agrees to implement reasonable and appropriate safeguards to protect the PHI; and
2.17.3. Will keep records of all Security Incidents involving PHI of which Business Associate becomes aware, and will report to Client all significant Security Incidents of which Business Associate becomes aware.
Electronic Data Security. To the extent that Contractor creates, receives, maintains or transmits electronic IICI, Contractor hereby represents and warrants that it will:
5.8.1. Implement administrative, physical and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic IICI that Contractor creates, receives, maintains or transmits on behalf of Alticor;
5.8.2. Ensure that any agent, including a subcontractor, to whom Contractor provides electronic IICI implements reasonable and appropriate safeguards to protect the IICI; and
5.8.3. Report to Alticor any security incident involving IICI of which Contractor becomes aware.
