Eligible and Excluded Populations. The State has sole authority for determining whether individuals or families meet any of the eligibility criteria of the Hoosier Healthwise program. The FSSA Division of Family Resources (DFR) makes eligibility determinations. Except for Native American members, enrollment in managed care is mandatory for Medicaid individuals in the children, pregnant women, and low-income family’s aid categories. It is also mandatory for children eligible for CHIP and presumptively eligible pregnant women. The specific eligibility aid category determines the benefit package. The following Medicaid enrollees are excluded from participation in Hoosier Healthwise managed care:  Persons in nursing homes and other institutions, such as ICF/MR and PRTF facilities;  Undocumented persons;  Persons receiving waiver or hospice services;  Wards and xxxxxx children; and  Children receiving adoption assistance.

Eligible and Excluded Populations. The State has sole authority for determining whether individuals or families meet any of the eligibility criteria of the HIP program. The FSSA Division of Family Resources (DFR) makes eligibility determinations. The Healthy Indiana Plan (HIP) is a Medicaid expansion for individuals 19-64 years of age with annual household income of not more than 138% of the federal poverty level (FPL), as calculated based on the Modified Adjusted Gross Income (MAGI) guidelines with 5% income disregard. All individuals eligible for HIP, with the exception of Native Americans, must enroll in managed care. Additional eligibility criteria are set forth in IC 12-15-44.2 and 405 IAC 10-4, as may be amended. The following individuals are not eligible for HIP:  An individual who participates in the federal Medicare program; and  An individual who qualifies for Medicaid under another aid category, with the exception of (i) the adult group under 42 CFR 435.119; (ii) pregnant women who choose to remain in HIP during the pregnancy; (iii) parents & caretaker relatives eligible under 42 CFR 435.110; (iv) low income individuals who are at least nineteen (19) years of age and less than twenty-one (21) years of age and eligible under 42 CFR 435.222; or (v) transitional medical assistance.

The prospective first tier participant certifies to the best of its knowledge and belief, that it and its principals: (1) Are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participating in covered transactions by any Federal department or agency; (2) Have not within a three-year period preceding this proposal been convicted of or had a civil judgment rendered against them for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State or local) transaction or contract under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen property; (3) Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity (Federal, State or local) with commission of any of the offenses enumerated in paragraph (a)(2) of this certification; and (4) Have not within a three-year period preceding this application/proposal had one or more public transactions (Federal, State or local) terminated for cause or default. b. Where the prospective participant is unable to certify to any of the statements in this certification, such prospective participant shall attach an explanation to this proposal.

  • DEBARMENT, SUSPENSION, INELIGIBILITY AND VOLUNTARY EXCLUSION By executing this contract the firm affirms that it is in compliance with the requirements of 2 C.F.R. Part 180 and that neither it, its principals, nor its subcontractors are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency.

  • Borrower Information Used to Determine Applicable Interest Rates The parties understand that the applicable interest rate for the Obligations and certain fees set forth herein may be determined and/or adjusted from time to time based upon certain financial ratios and/or other information to be provided or certified to the Lenders by the Borrower (the “Borrower Information”). If it is subsequently determined that any such Borrower Information was incorrect (for whatever reason, including without limitation because of a subsequent restatement of earnings by the Borrower) at the time it was delivered to the Administrative Agent, and if the applicable interest rate or fees calculated for any period were lower than they should have been had the correct information been timely provided, then, such interest rate and such fees for such period shall be automatically recalculated using correct Borrower Information. The Administrative Agent shall promptly notify the Borrower in writing of any additional interest and fees due because of such recalculation, and the Borrower shall pay such additional interest or fees due to the Administrative Agent, for the account of each Lender, within five (5) Business Days of receipt of such written notice. Any recalculation of interest or fees required by this provision shall survive the termination of this Agreement, and this provision shall not in any way limit any of the Administrative Agent’s, the Issuing Bank’s, or any Lender’s other rights under this Agreement.

  • Specific Exclusion Stanford does not: (A) grant to ***** any other licenses, implied or otherwise, to any patents or other rights of Stanford other than those rights granted under Licensed Patent, regardless of whether the patents or other rights are dominant or subordinate to any Licensed Patent, or are required to exploit any Licensed Patent or Technology; (B) commit to ***** to bring suit against third parties for infringement, except as described in Section 14; and (C) agree to furnish to ***** any technology or technological information other than the Technology or to provide ***** with any assistance.

  • Limitations and Exclusions The limitation and exclusion in this Section 8 shall not apply: (i) to the extent that liability cannot be limited or excluded according to the Applicable Law; (ii) in cases of our willful misconduct and gross negligence; (iii) in cases of bodily injuries or death caused by our negligence; and (iv) in cases of our fraud or fraudulent misrepresentation.

  • Eligible Population 5.1 Program eligibility is determined by applicable law set forth in Program rules and the requirements established in the Program Policy Manual. 5.2 The unduplicated number of Clients for PHC services is 430. This represents the Grantee’s projected number of unduplicated Clients to be served during the Contract period. If during the Contract period it is foreseen that the Grantee might be unable to serve the contracted number of children, HHSC may reduce the Grantee’s grant award amount.

  • Additional Exclusions A Receiving Party will not violate its confidentiality obligations if it discloses the Disclosing Party’s Confidential Information if required by applicable laws, including by court subpoena or similar instrument so long as the Receiving Party provides the Disclosing Party with written notice of the required disclosure so as to allow the Disclosing Party to contest or seek to limit the disclosure or obtain a protective order. If no protective order or other remedy is obtained, the Receiving Party will furnish only that portion of the Confidential Information that is legally required, and agrees to exercise reasonable efforts to ensure that confidential treatment will be accorded to the Confidential Information so disclosed.
