The 'Employer Violations' clause defines the actions or omissions by the employer that constitute a breach of the employment agreement or relevant laws. Employer Violations. Any Employer who intentionally violated any part of this Agreement shall be penalized for such violation, such as paying less than the established rate of pay or violating hours or employment, etc. If such violations are proven, the Employer shall pay double (2) times the amount involved.
Employer Violations. In the event of a violation of the hiring procedure or overtime clauses of this Agreement or a violation of Uniform Building Codes, the amount of damages sustained by a violation or breach would be impractical or extremely difficult to fix by way of actual damages. Therefore, it is agreed that the Employer shall pay, as liquidated damages, the sum of fifty dollars ($50.00) for each violation for each day the violation continues in addition to any monies due to any employee or to the Trust Funds or for any special damages that may be proved, said sum to be paid within forty-eight (48) hours.
