Engineering Lots. For each and every engineering Lot started by Jazz as an HVL or P1 lot, produced and delivered by Jazz at the request of Skyworks, Jazz shall make and hold a backup Lot, [. . . *** . . .], like the delivered HVL or P1 Lot. Unless otherwise agreed, Jazz will start the backup Lot within [. . . *** . . .] after starting the engineering Lot. Jazz shall hold the backup Lot at Metal One for a reasonable period of time not to exceed [. . . *** . . .], and upon receipt of a PO for the purchase of the back up lot, promptly complete and deliver the lot to Skyworks. Backup lots for any production P1 lot and HVL production lot shall be by mutual agreement only.

Engineering Lots. Engineering Lot pricing shall include a set-up charge per lot of three-hundred and fifty dollars ($350) and a standard cost charged monthly as identified in Exhibit B.
Engineering Lots. Xicor may order engineering lots where Xicor seeks the qualification of an Update or a Product not previously manufactured by ZMD, to seek or otherwise improve functionality and yield, or to make any other engineering changes. Engineering Lots. MARVELL may order engineering lots where it seeks the qualification of an update to a Product or a Product not previously manufactured by TSMC, or seeks to otherwise improve functionality and yield, or to make any other engineering changes. For purposes of this Agreement, an engineering lot shall contain 12 Wafers. It shall be MARVELL's responsibility to inform and provide TSMC with the specifications for the engineering changes to be made to an engineering lot before production begins.
Engineering Lots. HHNEC shall manufacture and deliver Engineering Lots to AOS in accordance with Schedule 3, part 2, with copies of all relevant test data sheets. During the engineering and Qualification phase, HHNEC shall provide AOS with results of PCM (Process Monitor), CP (Chip Probe) test, die-sort test and in-line monitor testing of every Lot as a partial progress report leading to the outgoing visual inspection specification. As soon as practicable after AOS’ testing of the Engineering Lots, AOS shall provide HHNEC a status update via electronic communications means. If AOS notifies HHNEC that any Wafers in an Engineering Lot are misprocessed for reasons attributable to HHNEC, HHNEC shall at its own expense use commercially reasonable efforts to rerun the Wafers and resubmit Wafers meeting the Specification and the Qualification Criteria. Before release to production, each Product shall fully meet the Qualification Criteria.

  • No Reverse Engineering Licensee may utilize and study the design, performance and operation of Xbox solely for the purposes of developing the Software Title. Notwithstanding the foregoing, Licensee shall not, directly or indirectly, reverse engineer or aid or assist in the reverse engineering of all or any part of Xbox except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. Reverse engineering includes, without limitation, decompiling, disassembly, sniffing, peeling semiconductor components, or otherwise deriving source code. In addition to any other rights and remedies that Microsoft may have under the circumstances, Licensee shall be required in all cases to pay royalties to Microsoft in accordance with Section 6 below with respect to any games or other products that are developed, marketed or distributed by Licensee, and derived in whole or in part from the reverse engineering of Xbox or any Microsoft data, code or other material.

  • ASBESTOS CONTAINING BUILDING MATERIALS Please be advised that an asbestos survey may have been performed at the Property. If provided, please review the information that identifies the locations of known asbestos containing material or presumed asbestos containing material. All personnel and appropriate subcontractors should be notified of the presence of these materials, and informed not to disturb these materials. Any activity that involves the disturbance or removal of these materials must be done by an appropriately trained individual/contractor.

  • Environmental Assessment In connection with its surrender of the Premises, Tenant shall submit to Landlord, at least fifteen (15) days prior to the expiration date of this Lease (or in the event of an earlier termination of this Lease, as soon as reasonably possible following such termination), an environmental Assessment of the Premises by a competent and experienced environmental engineer or engineering firm reasonably satisfactory to Landlord (pursuant to a contract approved by Landlord and providing that Landlord can rely on the Environmental Assessment). If such Environmental Assessment reveals that remediation or Clean-up is required under any Environmental Laws that Tenant is responsible for under this Lease, Tenant shall submit a remediation plan prepared by a recognized environmental consultant and shall be responsible for all costs of remediation and Clean-up, as more particularly provided in Section 5.3, above.

  • ADJACENT EXCAVATION-SHORING 32. If an excavation shall be made upon land adjacent to the demised premises, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, license to enter upon the demised premises for the purpose of doing such work as said person shall deem necessary to preserve the wall or the building of which demised premises form a part from injury or damage and to support the same by proper foundations without any claim for damages or indemnity against Owner, or diminution or abatement of rent.
