Licensee agrees to take full and absolute responsibility for compliance with this provision and further agrees that should any such performances be allowed or conducted by them which is adjudged by a court of final jurisdiction to violate this section, then in that event Licensee agrees to pay to Licensor, in addition to the sum herein required, an additional amount equal to three times such an amount as penalty and liquidated damages.
