Participant Requirements. You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.
Participant Requirements. Each Participant, whether providing, receiving or using information hereunder, shall:
a. provide all Authorized Users with appropriate education and training on the requirements of this Agreement; and
b. provide copies of its privacy and security policies and procedures to the other Participants and, upon reasonable request by another Participant, demonstrate compliance with its policies and procedures.
Participant Requirements. Each Participant, whether providing, receiving or using information hereunder, shall:7
a. establish and implement appropriate policies and procedures to prevent unauthorized access, use and disclosure of Protected Information and ensure that such policies and procedures do not conflict with and are not less restrictive than this Agreement;8
b. regularly monitor and audit access to Protected Information and take reasonable steps to pursue, address and mitigate any breach or other privacy and security issues detected by such monitoring;9
c. notify the affected Participants, as soon as reasonably possible, of any Significant Breach and take all reasonable steps to mitigate the breach (for purposes of this subsection c., “affected Participants” shall include any Participant regarding which there is a reasonable possibility that the Participant’s System or data thereon could be negatively impacted by the Significant Breach);
d. make its internal practices, books and records relating to uses and disclosures of Protected Information available to the Secretary of the U.S. Department of Health and Human Services or his/her designee, as necessary to comply with HIPAA or other applicable State and federal law;
e. provide all Authorized Users with appropriate education and training on the requirements of this Agreement; and
f. provide upon request copies or detailed summaries of its privacy and security policies and procedures to the other Participants and, upon reasonable request by another Participant, demonstrate compliance with its policies and procedures.10

Each participating location must also meet the following requirements: • Internet, Computer & Software as per Schedule “A” - Technical Requirements • A minimum of one (1) designated contact person per school (each, a "Contact Person") for communicating with the students: o Each Contact Person will also receive some guidance from the Service Provider for supporting the students' development. o Each Contact Person will also be generally available to help the students log in to their virtual backpack outside of the therapy sessions. • The criteria for becoming a TinyEYE therapy student shall include: o The parties acknowledge and agree that all referrals might not qualify for therapy. Children will be seen when the Service Provider has received (i) a referral request, (ii) background information. The Service Provider will provide templates for these forms. • Customer Acknowledgements Regarding Student/Parent Consent o The Customer hereby agrees: ▪ The Customer represents that any student/parent receiving services hereunder, as applicable, has been informed that Service Provider will deliver services virtually and that the student/parent does not object to virtual services. ▪ The Customer acknowledges that it has informed and received consent from any student/parent receiving services hereunder that, as part of the services provided, sessions may be recorded by the Service Provider, and data from the recorded sessions may be shared among other similar professional contractors to the Service Providers that are bound by confidentiality agreements and are able to contribute to the outcome of the services provided. Data from the recorded sessions may also be shared with confidentiality-bound employees of the Service Provider, with the Customer at its request, or be used for research purposes without any identifiable information of the participants of the sessions. ▪ The Customer acknowledges that education-related information about students and the services provided hereunder to those students may be transmitted between Customer and Service provider by electronic mail. ▪ The Customer represents that it shall immediately notify Service Provider if student/parent consent for any of the items above has been withheld or withdrawn. ▪ The Customer shall defend, indemnify and hold the Service Provider harmless from any and all losses, damages, and/or claims that the Service Provider may incur as a result of parental or student consent being withheld or withdrawn for any ...

Participant Requirements. Visitors must be physically and emotionally capable of participating in the Activities of OMOA, without being a danger to themselves or others. They must be participating voluntarily and not under the influence of drugs , alcohol or medications of any kind. Participants in the Treetop Quest and Spider Quest events must weigh no more than 250 pounds and have a flat footed reach of at least 4’5”. While on an obstacle course participants must wear a harness provided by OMOA, attached by a lanyard and carabineer to a continuous belay system. Parents of visitors 17 years of age or younger must remain reasonably available to the child while on the premises of the park. The Adult Visitor, or Parent, is responsible for determining his or her, or the Minor Visitor’s, suitability for the Activities and must seek assistance from the OMOA staff if suitability is in doubt. A visitor who fails to follow instructions and rules of the park or is otherwise considered by OMOA staff to be a danger to themselves or others may be removed from the Activity at any time at the sole discretion of staff and without the refund of fees paid. A misrepresentation of a participant’s weight, or of any other characteristic pertaining to safety, intentional or not, will cause the visitor to be a trespasser, and entitled only to the rights and privileges of a trespasser. In addition, in the event of such a misrepresentation, the Adult Visitor, or Parent, agrees to indemnify and protect OMOA from any claim of loss suffered or caused by him or her, and, if a Parent, suffered or caused by the Minor Visitor. I, an Adult Visitor, am aware that participation in the Activities involves risks of harm to visitors and their property. These risks include slips and falls, uneven and sometimes difficult terrain, collisions with trees, platforms and other natural or man-made objects and other visitors, and the negligence of other visitors and OMOA staff, including the failure of staff to protect me, or the Minor Visitor, from unreasonable risks of harm. There will be times when visitors will not be supervised or even observed by OMOA staff members. The outdoor environment of the Activities will expose participants to the natural elements, including weather, falling timber, heat and cold, and possibly harmful plants, insects and animals, contact with which might cause injury, including allergic reactions. School District students who desire to enroll in courses pursuant to this Contract must have been referred by the School District and must meet eligibility requirements set forth in this Contract. To be eligible to enroll in an arts and science course pursuant to this contract, a School District student shall demonstrate proficiency in reading, mathematics, and science as evidenced by: state assessment achievement scores, alternative proficiency measures established by the school board or by the jointly approved college readiness measures between the School District and the College. School District students enrolling in arts and science or career and technical coursework must also meet college course prerequisites and/or achieve a satisfactory score per the College approved placement instrument (Accuplacer, ACT, ALEKS, Cumulative GPA.) These requirements may be waived at the request of the student or the School District with the approval of the College’s Vice President of Teaching and Learning. Students who are recommended for such a class should have sufficient background to indicate probable success in the College class.

I understand that my responsibility to participate in the Program includes, but is not limited to, the following: I understand that I am solely responsible for ensuring I have the correct and valid documents and medical requirements for travel and the inability to meet these requirements may result in my inability to participate in the Program and I will not be refunded any costs based on my inability to meet these requirements. I understand that all communication regarding the Program will be done through my official Institution email address and that I am responsible for information that is distributed through this email address. I understand that during the course of the program I am required to maintain a cellular phone that supports international data and cellular service and coverage for the region in which I am traveling; As part of this coverage, and prior to travel, I understand I will be required to download selected applications and technology that will be used during the trip and may be critical to compliance with the emergency response system for our program. I understand that upon acceptance to the Program that I will be required to provide important information prior to departure, which includes supplying correct emergency contact information and other information used for safety purposes. Course credit fees, the Program fee, and airfare may all be eligible to be covered by financial aid. If a student is interested in obtaining financial aid to fund a Program, he/she must contact the financial aid office immediately and the student aid advisors will discuss all funding options available. Your Institution’s Student Handbook includes further information about financial aid disbursement, discounts, payment plans, timeline for drop/withdrawal and the refund percentage based on the date of drop/withdrawal. I agree that this Agreement is to be construed and governed under the laws of the State of United States where my campus of enrollment is located and that if any portion is held invalid, the balance hereof shall continue in full legal force and effect.
