Evidence of Transactions. A paper transaction record dispensed mechanically by using the Debit Card constitutes a record of my instructions. Whether such a transaction record is issued or not, it is my responsibility to verify that the transaction has been properly executed by checking my Account activity on a regular basis. In the absence of evidence to the contrary, the records of my Credit Union are conclusive for all purposes, including litigation, in respect of any instructions given by me to my Credit Union through the use of the Debit Card; the items deposited by me into an automated teller machine; the making of a withdrawal, deposit or transfer through the use of the Debit Card; and any other matter or thing relating to the state of Accounts between me and my Credit Union in respect of any electronic transaction.
Evidence of Transactions. In the event that we institute legal action against you in connection with this account, we may introduce into evidence a copy, microfilm, or microfiche of any document evidencing transaction under this Cardholder Agreement and such copy, microfilm or microfiche shall be deemed as valid as the original document.

This Agreement replaces any prior agreement governing the use of the Debit Card and the PIN, but does not replace or supersede any agreement or provision of any agreement relating to any loan, credit facility or the operation of any Account. This Agreement applies to any Account specified herein and, as well, to any other Account designated by me from time to time for use in connection with the Debit Card or Mobile Payment Service.
Evidence of Transactions. Administrative Agent shall have received evidence, in form and substance reasonably satisfactory to Administrative Agent, that (i) all amounts outstanding or becoming due under the Mezzanine Note Agreement have been repaid in accordance with the Funds Flow Memorandum, (ii) the Mezzanine Note Agreement and the Subordination Agreement have been terminated, and (iii) a dividend of $25,000,000 from Company to Parent to Hourglass Holdings, LLC has been paid in accordance with the Funds Flow Memorandum.
Evidence of Transactions. Bank shall have received evidence satisfactory to it that, immediately upon the initial funding of the Loan, the Acquisition will be completed and the Transaction will be fully effected, including but not limited to receipt by Bank of the certificate of merger filed with the Delaware Secretary of State, such that the Borrower shall be the surviving entity and thereby succeed to C/M Holdings, Inc.'s right, title and interest in the capital stock of Xxxxxxx Xxxxxx Xxxxxx Group Inc.
Evidence of Transactions. The Company will provide Consultant with evidence of any potential or completed transaction relating to this Agreement forthwith and will keep Consultant appraised of all communications relating to such transaction.
Evidence of Transactions evidence in any form
Evidence of Transactions. (a) All use of your Debit Card and PIN are subject to our verification and acceptance. This may take place on a date later than the date you use your Debit Card and will be in effect when transactions become effective.
(b) Transaction records of your Debit Card and PIN use are issued to help you with your Account recordkeeping. Whether or not a transaction record is issued to you, it is your responsibility to verify that the transaction has been properly executed by checking the periodic statement or passbook entries itemizing transactions.
(c) In the absence of evidence to the contrary, our records showing the use of your Debit Card and PIN and our determination of the details of that transaction, including our count and verification of the particulars of any Debit Card and PIN use, will be considered correct and binding on you. You must inform us of any mistakes within 30 days of the date of a disputed transaction, or such longer time period as may be required by an agreement between you and us for the operation of the Account to which the mistake relates.
Evidence of Transactions. 15.1. Merchant must retain the original and/or copies of the Transaction Data until the date such information is no longer required for Luxon to meet Applicable Laws or otherwise for at least [thirteen (13)] months and produce them to Luxon on request.
15.2. Merchant is responsible for ensuring that all Transaction Data which Merchant shall retain or 2 Note to Luxon - to discuss inclusion of (viii) which is favourable to Luxon, but not the customary approach taken in English law arrangements. submit to Luxon is complete and not lost or damaged and that all Transaction Data is securely held in and can be reconstituted in a complete and easily readable form.
15.3. It is Merchant’s responsibility to ensure that the Transaction Data can be reconstituted if corrupted, lost or damaged, and Luxon will not in any circumstances be liable in respect of the face value of any Transaction Data for the costs of reconstituting such data or for any other corruption, loss or damage.

In the absence of evidence to the contrary, the records of BlueShore Financial are conclusive for all purposes, including litigation in respect of: (a) any Instructions given to BlueShore Financial; (b) the making of a withdrawal, deposit, payment or transfer through the use of the Access Card, POS or the Remote Access Services; (c) any other matter or thing relating to the state of Accounts between you and BlueShore Financial in respect of any Transaction.
